Local rail passenger transport services (SPNV) - Network 35 Stuttgart - Lake Constance (Lots 1 - 3)

Local rail passenger transport services (SPNV) on network 35 (lots 1 to 3). The scope of services is – depending on the commissioning stage – total. vsl. up to 29.5 million train-km p.a. Operations commence vsl. to the international timetable change in Dec. 2023 for lot 3 and to the international timetable change in Dec. 2025 for lots 1 and 2. For the services in Lots 1 and 2, new vehicles or new vehicles are to be used, which are procured by the Schienenfahrzeuge Baden-Württemberg AöR (SFBW) and (are to) be provided to the successful vehicle within the framework of LCC models. For the services in lot 3, the SFBW will provide used vehicles, which are to be maintained and maintained by the winning applicant/bidder. Furthermore, the winning applicant/bidder must build and operate at least one workshop in the area of the southern runway. Lot 3 also includes the acquisition of the shares in SWEG Bahn Stuttgart GmbH (SBS), previously Abellio Rail Baden-Württemberg GmbH.

Local rail passenger transport (SPNV) in network 35 lot 1 with new vehicles (double-decker multiple-unit trains) of the type Alstom Coradia Stream High Capacity in the LCC model. Transport services are awarded as gross contracts. The duration of the transport contract in Lot 1 is expected to be 15 years. Depending on the commissioning stage, the scope of services in Lot 1 is expected to be between 7 and 10 million train-kilometres per year. Operations will commence from December 2025 in several stages of commissioning (further stages expected 06/2026, 12/2026, 12/2030, 12/2032, etc. depending on the completion of infrastructure measures and the inflow of new vehicles) on the following routes or route sections:

- Karlsruhe – Stuttgart – Ulm – Friedrichshafen – Lindau

- (Karlsruhe -) Pforzheim – Stuttgart - Tübingen – Sigmaringen

- Bretten – Mühlacker – Stuttgart

Furthermore, the transport authority reserves the right to order further services on all electrified routes in Baden-Württemberg as well as on the following routes outside Baden-Württemberg (together with the neighbouring transport authority):

- State border Baden-Württemberg/Bavaria – Nuremberg

- State border Baden-Württemberg/Bavaria – Würzburg

The transport authority reserves the right to award sales services separately or to gradually withdraw them from the contract.

The winning applicant/bidder must conclude a provision contract for the vehicles with the SFBW.

Further details on the current status can be found in the participation brochure, whereby the public authority and the SFBW reserve the right to adapt the requirements.

MEX network

Transport services in local rail passenger transport (SPNV) in network 35 lot 2 with new vehicles (double-decker multiple-unit trains) of the type Alstom Coradia Stream High Capacity within the framework of a so-called LCC model as well as vsl. single-deck electric vehicles in a leaning LCC model. Transport services are awarded as gross contracts. The duration of the transport contract in Lot 2 is expected to be 15 years. Depending on the commissioning stage, the scope of services in Lot 2 is expected to be between 6.5 and 11 million train-kilometres per year. Operations will commence from December 2025 in several stages of commissioning (further expected 06/2026, 12/2026, 12/2027, 12/2030, 12/2032, inter alia depending on the completion of infrastructure measures and the inflow of new vehicles) on the following routes or route sections:

- Göppingen – Stuttgart – Crailsheim

- Aalen – Stuttgart – Tübingen

- Stuttgart – interim stop Nord/ Vaihingen – Freudenstadt/Horb – Villingen

- Stuttgart – Heilbronn

Furthermore, the transport authority reserves the right to order further services on all electrified routes in Baden-Württemberg, as well as on the following routes outside Baden-Württemberg (together with the neighbouring transport authority):

- State border Baden-Württemberg/Bavaria – Lindau

- State border Baden-Württemberg/Bavaria – Nuremberg

- State border Baden-Württemberg/Bavaria – Würzburg

The public transport authority reserves the right to award sales services separately and to withdraw them from the contract. This is done in several stages.

The winning applicant/bidder must conclude a provision contract with the SFBW.

North Baden-Upper Swabia

Regional rail transport services in network 35 lot 3 with provided vehicles of the type Talent in the BW model. The provision will take place at the international timetable change Dec. 2023 for the North Baden area. The vsl. Further single-deck electric vehicles will be provided in stages between Dec. 2025 and Dec. 2027. Transport services are awarded as gross contracts. The contract term in lot 3 is vsl. 9 years. Depending on the commissioning stage, the scope of services is vsl. between 4.5 and 8.5 million train-km p.a.

The successful party will not provide the transport services himself, but through SWEG Bahn Stuttgart GmbH (SBS), which is to be acquired 100% by him. Schienenfahrzeuggesellschaft Baden-Württemberg AöR (SFBW) leases the vehicles and the workshop in Pforzheim to SBS during the transport contract.

That gross transport contract provides for a subsidy which SBS, as the RU providing the transport services, receives from the transport authority. The amount of the grant is determined between the bidders in competition. The successful party will conclude a purchase agreement with SWEG Südwestdeutsche Landesverkehrs-GmbH (SWEG), represented by the public transport authority, for all shares in SBS, so that SBS will take over the transport services vsl. as a subsidiary of the successful party. The successful party takes over the shares at the time when SBS must provide the transport services (Dec. 2023).

The purchase price for the shares is identical for all applicants/bidders. The successful party is free to rename SBS or merge it. Currently, SBS is still the owner of a workshop in Pforzheim which vsl. is acquired by the SFBW during the award procedure and then leased back to SBS until the end of the transport contract.

Part of lot 3 is also the construction of at least one further workshop (for the Upper Swabian area) - see point II.2.14).

The acquisition of the shares is subject to vsl. merger control by the Bundeskartellamt.

This is the responsibility of the respective applicant/bidder. The contracting authority suggests contacting the Bundeskartellamt as early as possible.

Operations will commence from Dec. 2023 in several stages of commissioning (further vsl. 12/2025, 06/2026, 12/2026, 06/2027 depending on the completion of infrastructure measures) on the following routes or sections:

- Mannheim – Heilbronn

- Osterburken/Neckarelz/ – Heilbronn – Stuttgart – Tübingen

- Stuttgart – Pforzheim – Karlsruhe/Bad Wildbad

- Heilbronn – Öhringen-Cappel

- Heidelberg – Osterburken

- Stuttgart – Ulm

- Heidelberg – Mühlacker

- Ulm – Aulendorf – Friedrichshafen – Lindau

The transport authority reserves the right to provide further services on the following further routes or routes.

- Osterburken – Lauda – Würzburg

- Meckesheim – Aglasterhausen

- Karlsruhe – Heilbronn

- Tübingen – Herrenberg

- Tübingen – Horb

- Neu-Edingen/ MA-Friedrichsfeld – Mannheim/ Schwetzingen/ Heidelberg

- Mannheim – Karlsruhe

- Stuttgart – Schwäbisch Gmünd (-Aalen – Crailsheim)

- Aalen – Ulm

- Stuttgart – Horb

- Steinsfurt – Eppingen

- Mannheim – Ludwigshafen

The public transport authority reserves the right to award sales services separately and to withdraw them from the contract.

It cannot be ruled out that SWEG, as the current sole shareholder of SBS, will participate in the award procedure. Should it be awarded the contract, it will not have to pay itself the purchase price for SBS's shares. Economically, it is placed as if it had paid the purchase price. This is because SWEG's claim against the contracting authority for reimbursement of the price for the acquisition of the shares in SBS in insolvency proceedings via Abellio Rail Baden-Württemberg GmbH would lapse.
