The subject of the contract is the provision of transport and development (collection and processing) of municipal waste.

The Contracting Authority provides for the application of the so-called reverse procedure referred to in Article 139 (1) of the Law of Public Procurement, i.e. the Contracting Authority shall first examine and evaluate the tenders and then make the subject qualification of the Contractor whose offer has been highest assessed, in the absence of grounds for exclusion and compliance with the conditions of participation in the proceedings.

4. The Contracting Authority does not provide for an electronic auction.

5. The Contracting Authority shall not conduct proceedings to conclude a framework agreement.

1.The subject of the contract is the provision of transport services

and development (collection and processing) of municipal waste:

(a) unsegregated (mixed) municipal waste — Waste code

20 03 01, in a quantity of 2500Mg/year, transmitted for recovery and disposal in accordance with the applicable rules,

(b) biodegradable waste — waste code 20 02 01, amounting to 450Mg/year, transmitted for recovery,

(c) waste collected selectively — waste code 15 01 01 01, 20 01 01 01, 15 01 02, 20 01 39, amounting to 900 Mg/year, transmitted for recovery and recycling,

(d) bulky waste — waste code 20 03 07, quantity 400Mg/year, transmitted for recovery and disposal,

produced by the inhabitants of the municipality of Sułkowice, supplied by the operator receiving municipal waste, for a period of 12 months, i.e. from 1.01.2022 to 31.12.2022.

2. The transport of the waste will take place from the transhipment point located in Sułkowice at 133 Millennicia Street, to the place of use in accordance with the requirements laid down by the provisions of the Waste Act of 14 December 2012 (i.e. 2021, Journal of Laws, item 779 as amended).

3.The quantities of waste intended for development, determined on the basis of reports submitted by entrepreneurs carrying out the waste management service in the Sułkowice Municipality in the period 2019-2020:

The quantities provided are not the basis for the estimate of the value of This information is provided in order to depict the situation already existing and has been obtained from reports submitted by operators operating the municipal waste management service on the premises of Sułkowice Municipality.

The quantity of waste produced is not dependent on the Contracting Authority, the quantity calculated is estimated and may change according to the actual needs of the Ordering Party. The Contracting Authority reserves the right to reduce or increase the quantities transferred to the use of waste, depending on actual needs, without the Contractor's right to claim damages in this respect.

The duties of the Contracting Authority shall include the loading of waste into means of transport substituted by the Contractor.

II.DETAILED OBLIGATIONS OF THE CONTRACTOR

The contractor is obliged to:

1.Providing containers for the collection of municipal waste:

.two containers for non-segregated waste (mixed) by 40m3,

b.one container for biodegradable waste by 20m3, and

c.two containers for segregated waste by 40m3

Containers should be substituted by 31.12.2021 unless the conclusion of the contract occurs after that date (in this case 2 working days from the date of conclusion of the contract).

2.Ensure the possibility of collecting the above waste continuously without delay.

3.Supports substituted containers (replacement) on working days of the week i.e. Monday to Friday from 7:00 to 15:00

4.Receipt of waste after prior notification (by telephone or e-mail) by the Contracting Authority, the time from the notification to the collection of the waste collected shall not be more than 48 hours.

5.Transport of waste, which takes place from the transhipment point located in Sułkowice at 133 Millennicia Street:

a.Unsegregated (mixed) municipal waste - for municipal installations placed by the Marshals of the Provinces in the Public Information Bulletin and to the Municipal Waste Management Plans indicated in the Provincial Municipal Waste Management Plans (RIPOK installations — indicated in the Provincial Waste Management Plan of the Lesser Poland Voivodeship);

b.selectively municipal waste for recycling, recovery and disposal installations in accordance with the hierarchy of waste handling referred to in Articles 17 and 20 of the Act
