1. The subject of the contract is the provision of municipal waste collection and management services in the commune of Siewierz in 2019.

2. The subject of the order has been specified in detail in Annex 10 to the Specification of the Essential Terms of the Order - The detailed description of the subject of the contract and includes in particular:

1) collection and management of municipal waste from owners of real estate residing in the city and commune of Siewierz,

2) collection and management of municipal waste from the owners of real estate, used only for part of the year, where residents do not reside, but there are summer houses in the City and Commune of Siewierz,

3) running the Municipal Waste Selective Collection Point located in Siewierz at ul. 36,

4) collection and management of segregated municipal waste collected in bell containers located at 6 points in the commune of Siewierz.

The detailed description of the order is set out in Annex 10 to the Specification of the Essential Terms of the Order.

1. Waste management is to ensure achieving appropriate levels of recycling, preparing them for re-use and recovery by other methods and reducing the weight of biodegradable municipal waste sent to landfill in accordance with applicable regulations.

2. During the implementation of the task, the Contractor is obliged to comply with the law, including local law.

3. The Contractor shall be liable for damages caused by his fault, e.g. damage to the property of the Employer or third parties, in connection with the performance of the service.

4. The contractor will receive from the Employer after signing the contract a list of real estate from which municipal waste will be collected. The list of real estate will be updated by the Ordering Party as needed resulting from declarations submitted by property owners.

5. The Contractor is obliged to prepare a waste collection schedule and to print it and distribute it to the owners of residential real estate and among real estate owners, used only for part of the year where residents do not live, and there are holiday homes, also in the event of any changes. The schedule requires approval by the Employer each time.

6. The contractor is obliged to monitor compliance with the obligation incumbent on the property owner in the field of selective collection of municipal waste.

8. The Ordering Party does not allow the collection of municipal waste from inhabited real estate together with waste from uninhabited real estate or waste from another commune, with the exception of waste from real estate from the commune of Siewierz used only for part of the year where residents do not reside holiday homes.

9. The Contractor shall bear all costs related to the collection, transport and management of waste as well as all other costs of the order, including: costs of printing waste collection schedules and any changes, costs of printing leaflets as well as the costs of providing them to property owners. In addition, the costs also include the fee for placing waste in a landfill, the so-called marshal fee - for a mass of waste whose disposal by storage will be necessary as part of its management by the Contractor.

10. The Contractor shall appoint a person as a coordinator to perform the obligations arising from the contract on the part of the Contractor.

11. The Contractor is obliged to run and operate a municipal point for the selective collection of municipal waste from owners of inhabited real estate and from owners of real estate used only for part of the year where residents do not live, but there are summer houses located in the commune of Siewierz, hereinafter referred to as PSZOK - in accordance with the provisions of the ToR and the Detailed description of the subject of the contract.

12. The contractor is required to obtain a permit for waste collection at PSZOK during the performance of the contract.

13. The Contractor is obliged to manage the municipal waste collected in accordance with applicable regulations.

14. The Employer requires employment on the basis of an employment contract by the Contractor or subcontractor of the following persons performing activities in the field of the contract, in accordance with the provisions of the ToR.
