Description:
Meat deliveries to the Police School in Katowice for a period of 6 months.

1. The subject of the contract is the supply of meat to the Police School in Katowice for a period of 6 months.

2. Detailed description of the subject of the contract: The full list of the assortment being the subject of delivery and the maximum quantity of ordered products is given in the assortment-quantity-value specification constituting Annex 1A to the SWZ.

3. The Ordering Party reserves the option of not fulfilling the subject of the contract worth up to 50% of the total gross remuneration. No financial or legal claims are entitled to the Contractor's part of the contract.

4. Delivery, unloading and contributing will be made at the Contractor's expense calculated in the price of the products covered by the contract

2. Detailed description of the subject of the contract:

1) The full list of assortment being the subject of delivery and the maximum quantity of ordered products is given in the assortment-quantity-value specification constituting Annex 1A to the SWZ.

2) The quantities provided are estimates and do not oblige the Ordering Party to purchase products in those quantities.

3) in order to confirm that the deliveries offered conform to certain requirements, the Contracting Authority requires the Contractor to submit, together with the offer, product cards or other documents from which their composition will result and comply with the requirements laid down by the Contracting Authority in the assortment Specification- quantitative value as annex No 1A to SWZ.

3. Proposing products inconsistent with the requirements of the Contracting Authority shall be tantamount to rejecting the Contractor's offer pursuant to Article 226(1)(5) of the PPL Act - as inconsistent with the terms of the contract.

4. The quantities provided are estimates and do not oblige the Ordering Party to purchase products in those quantities.

5. The Ordering Party reserves the right not to perform the subject of the contract with a value of up to 50% of the total gross remuneration. For non-performance of part of the contract, the Contractor is not entitled to any financial or legal claims.

6. Delivery, unloading and bringing in the subject of the contract shall be carried out at the expense of the Contractor included in the price of products covered by the public procurement contract.

7. Delivery of the subject of the order shall be performed by means of transport of the Contractor permitted for the carriage of food.

8. Persons performing the delivery must have a current medical certificate for sanitary and epidemiological purposes, which they present at the request of the Ordering Party.

9. The Contractor is obliged to have a current certificate of entry in the register of establishments subject to official control of the competent authorities - in accordance with the Act of 25 August 2006 on food and nutrition safety (i.e. Journal of Laws of 2020, item 2021,

As of late as) or the current administrative decision to enter the register of establishments or to approve an establishment issued by the county veterinarian, together with the identification number assigned in accordance with Article 21 (4) of the Act of 16 December 2005 on products of animal origin (i.e. Journal of Laws of 2020, item 1753 of late). The Contractor must be subject to the permanent supervision of the competent authorities.

10. The offered products must meet the requirements set out in the applicable legal provisions regarding the production and marketing of food. Each product must be manufactured and placed on the market in accordance with the requirements of the HACCP system.

11. Details of the delivery are set out in the model contract constituting Annex 5 to the SWZ.

12. The Contractor shall ensure the protection of the personal data provided, in accordance with the Act of 10 May 2018 on the protection of personal data (i.e. Journal of Laws of 2019, item 1781) and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as GDPR) (Journal of Laws of 2019, item 1781). UE L 2016, no. 119, p. 1). The obligation to inform Subcontractors, third parties and consortium members about the processing of personal data rests with the Contractor. The Contractor's statement on the fulfillment of the obligations arising from Article 13 or Article 14 of the GDPR towards natural persons from whom personal data has been directly or indirectly obtained in order to apply for this contract will be submitted in the offer form – constituting Annex 1 to the SWZ.
