The subject of this award procedure is the conclusion of a framework agreement per lot with a trading partner for the procurement of all Microsoft products available within the term of the contract in the categories mentioned, possibly with software assurance.
Microsoft products are licensed for those entitled to purchase if individual licenses are required on the basis of the terms and conditions concluded between the Federal Republic of Germany, represented by the Federal Ministry of the Interior (BMI), or in the case of the FWU contract, the FWU Institute for Film and Picture gGmbH and Microsoft Ireland Operations Limited (Microsoft) have been closed:
- Group contract (also called Enterprise Agreement),
- Microsoft Select Plus Contract Academic,
- general contract for business and service,
- FWU 3.0 contract.
For the purpose of specifying the products, the clients refer to the current Microsoft product list (to be found at http://www.microsoft.com/licensing/contracts and there under Product List, German).
The subject of the framework agreement is the brokering of licenses by the contractor (s) to the beneficiaries. Licensing takes place directly between Microsoft and the beneficiaries. The contractor's contractual obligations per lot and per framework agreement result from the provisions of the award documents and their annexes.
For each lot, the framework agreements include the following tasks of the contractor with regard to the procurement and licensing of the aforementioned products:
a) It is the task of the contractor to advise the respective customer and to determine the necessary licenses for the stated purposes and the intended use according to the specific needs described. Against the background that orders can be triggered both by an authorized municipal data center for himself or for his customers as well as by the authorized institutions, which either operate corresponding systems themselves or have them operated (hosted) by third parties, the contractor has the right ones Identify license models, metrics and licensees.
The contractor also advises beneficiaries regarding possible maintenance and support services / products from the manufacturer Microsoft, regardless of how, when and by whom these Microsoft licenses or products were obtained;
b) The contractor also takes over the entire processing of the license acquisition of the Microsoft licenses and products for the respective licensee, in particular also the registration as an affiliate or an accession and billing the licensor;
c) In addition, the contractor offers services in connection with the intended acquisition (in particular reporting, statistical and information services and the possibility to participate in free training courses from Microsoft).
It is expressly pointed out that all requirements are KO criteria in the sense of exclusion criteria, the non-compliance of which leads to the exclusion of the offer.
