The subject of the contract are services in the field of forest management in accordance with the definition in Article 6 paragraph 1 point 1 of the Act of 28 September 1991 on forests (consolidated text: Journal of Laws of 2022, item 672 of późn.zm – "Forest Act") covering works in the field of forest breeding and protection, fire protection, logging and skidding, nature protection, tourist development along with accompanying works to be carried out in the Piekło Forestry in 2023. The procedure is conducted in an open tender pursuant to Article 129(1)(1) in conjunction with Article 129(2) and Articles 132-139 of the Act of 11 September 2019. Public procurement law (consolidated text: Journal of Laws of 2022, item 1710, as amended- "Public Procurement Law") and executive acts to the Public Procurement Law. The procedure is conducted in accordance with the rules provided for classic contracts with a value equal to or exceeding the EU thresholds. Procedure, i.e. 'reverse procedure'.
Provision of forest management services in the Piekło forestry area in 2023. The material scope of the contract includes the total amount of works in the field of forest breeding and protection, fire protection, harvesting and skidding, seeds, nature conservation, tourist development along with accompanying works resulting from the Appendix. No. 2 to the SWZ, which consists of:
Incl. No 2.1.–the planned size of the work; Incl. No. 2.2.-detailed size of works by groups of activities, activities and location; Incl. No. 2.3.1. – characteristics of forestry in the field of timber harvesting; Incl. No 2.3.2.–assortment system of timber harvesting in forestry; Incl. No. 2.3.3.–a statement of the distance and conditions of harvesting wood; Incl. No. 2.3.4.–list of items with additional difficulties in terms of harvesting and skidding; Incl. No 2.3.5.–a list of items not made available for machine extraction; Incl. No. 2.3.6. – information on the optimal technology of obtaining wood (potential); Incl. No 2.4.1.-information on the nature of forest care (zones for mowing weeds); Incl. No 2.4.2.-a list of items not made available for renewal with the planter.
The material ranges listed in the annexes included in Annex 2 to the SWZ are estimates. Quality standards relating to all essential features of the subject of the contract are specified in the Annex. No. 3 to the SWZ, which consists of:
Appendix 3.1." Description of the standard of forestry performance technology" adopted by Decision No. 34 of the General Director of the State Forests of May 12, 2022 on the introduction of the "Description of the standard of forestry work performance technology" in organizational units of the State Forests amended by Decision No. 86 of the General Director of the State Forests of 19/07/2022; Incl. No 3.2. Description of the standard of forestry works performance technology in the Regional Directorate of State Forests in Olsztyn adopted by Decision No. 47 of the Director of the Regional Directorate of State Forests in Olsztyn of July 28, 2022 regarding the amendment of the Annex to Decision No. 10 of the Director of the Regional Directorate of State Forests in Olsztyn of 15/06/2022 on the approval of activities to the description of the standard of forestry work performance technology in organizational units of the RDSF in Olsztyn.
Specified in Annex. nr3.1.do SWZ and in Zał. No. 3.2.do SWZ, a detailed description of the standard of technology for performing individual forest works (activities) is the basis for determining the quality requirements relating to the elements constituting the subject of the contract (Annex No. 2 to SWZ). If the activity described in the above-mentioned annexes is not provided for in the description of the subject of the contract (Annex No. 2 to SWZ), then in this respect the provisions of Annex 2 to the SWZ. no. 3.1.do SWZ and Zał. No 3.2 shall not apply to the SWZ. A description of the rules of the procedure for the acceptance of forest works is included in the Annex. No. 3 to SWZ. The general principles of the implementation of the subject of the contract are described in point 3.3.SWZ. The regulations that the Contractor will be obliged to comply with in particular when performing the subject of the contract are described in point 3.2.SWZ. The contracting authority provides for the possibility of awarding contracts referred to in Article 214(1)(7) of the Public Procurement Law within a period of 3 years from the date of award of the basic contract. The Ordering Party does not reserve the obligation of the Contractor to personally perform key tasks regarding the subject of the contract. Pursuant to Article 95 of the Public Procurement Law, the Contracting Authority requires the Contractor or a subcontractor to employ persons performing activities in the scope of contract performance consisting in obtaining and skidding wood raw material, if the performance of these activities consists in performing work in the manner specified in Article 22 § 1 of the Act of 26.06.1974 - Labour Code (consolidated text: Journal of Laws of 2022, item 1510, as amended).
The estimated value of the contract given below does not include the value of contracts referred to in Article 214(1)(7) of the Public Procurement Law and the Option.
