The subject of the contract is the supply of energy for the needs of the Góra Municipality, its organizational units, cultural institutions and companies. Statements and documents that the Contractor should submit together with the offer: 1) a completed offer form together with a completed table of forecasted consumption attached to SWZ,2) A copy of the National Court Register or CEIDG or other appropriate register in order to confirm that the person acting on behalf of the contractor is authorized to do so. The contracting authority applies the so-called reverse procedure, Article 139 of the PPL Act Contractors do not submit the ESPD together with the offer. 3) a statement on the absence of grounds for exclusion in the circumstances indicated in art. 7 section 1 of the Act, 4) power of attorney if the authorization does not result from the registration document

The estimated amount of energy supplied in the contractual period is forecast at about 2058389.00 kWh and concerns about 223 PPEE. Before selecting the most advantageous offer, the contracting authority shall call upon the contractor whose bid will be rated the highest to submit within the prescribed period, not shorter than 10 days, valid as at the date of submission of all subjective evidence listed in SWZ.1. An excerpt or information from the National Court Register or from the Central Register and Information on Economic Activity, within the scope of Article 109(1)(4) of the Act, drawn up not earlier than 3 months before its submission, if separate regulations require entry in the register or records, if not the Contractor has not indicated the address of a free and publicly available database in the statement under Article 125(1) of the PPL, respectively, in which they are available and the Ordering Party can download them himself/ 2. Information from the National Criminal Register within the scope specified in Article 108(1)(1), (2) and (4) of the PPL, issued no earlier than 6 months before its submission.

If the Contractor has its registered office or place of residence outside the territory of the Republic of Poland, instead of the above-mentioned documents, it shall submit:1) information from the relevant register such as a court register or, in the absence of such a register, another equivalent document issued by the competent judicial or administrative authority of the country in which the Contractor has its registered office or place of residence.2) Documents referred to in point 1), should be issued no earlier than 6 months before their submission.3) If the documents referred to in point 1) are not issued in the country where the Contractor has its registered office or place of residence, or if these documents do not refer to all the cases referred to in Article 108(1)(1), (2) and (4) of the PPL, they shall be replaced in whole or in part, as appropriate, by a document containing the Contractor's statement, indicating the person or persons authorised to represent it, or a declaration of the person to whom the document was to relate, made under oath or, if there are no provisions on sworn declaration in the country where the Contractor has its registered office or place of residence, made before a judicial or administrative authority, notary, professional or economic self-government body, competent for the seat or place of residence of the Contractor. The provision of point 2) shall apply mutatis mutandis.

3) A statement of the Contractor, within the scope of Article 108(1)(5) of the PPL, on the lack of belonging to the same capital group, within the meaning of the Act of 16 February 2007 on competition and consumer protection (i.e. Journal of Laws of 2021, item 275), with another Contractor who submitted a separate bid, or a statement on belonging to the same capital group together with documents or information confirming the preparation of the offer independently of another Contractor belonging to the same capital group./ shall be submitted by the Contractor/Contractor acting jointly and the entity making the resources available, with the proviso that the Contractor making the resources available does not submit a statement on the validity of the information contained in the statement referred to in Article 125 paragraph 1 in the scope of Article 108 paragraph 1 point 5/. 4) Contractor's statement on the validity of the information contained in the statement referred to in Article 125(1) of the Act, with respect to the grounds for exclusion from the procedure indicated by the Contracting Authority, referred to in Article 108(1)(3), (4), (5) and (6) and the validity of the statement on the grounds for exclusion pursuant to Article 108(1)(3), (4), (5) and (6) and the validity of the statement on the grounds for exclusion pursuant to Article 125(1) of the Act. Article 7(1) of the Act on special solutions in the field of counteracting support for aggression against Ukraine and serving the protection of national security and pursuant to Regulation 2022/576/ shall be submitted by the Contractor/Contractors acting jointly and the entity providing resources/. Before selecting the most advantageous offer, the Contracting Authority shall call the Contractor whose offer has been rated the highest to submit the ESPD;
