1.The subject of the procedure is “The supply of electricity to the Purchasing Group set up by the City of Leszno for the period 2022-2023.” 2. The supply of electricity will be carried out in accordance with applicable law, in particular under the conditions laid down by the Law of 10 April 1997 — Energy law (i.e., Journal of Laws of 2021, item 716 as amended), by implementing regulations of this law, in particular by the Regulation of the Minister of Economy of 4 May 2007 on the detailed conditions of the operation of the electricity system (Journal of Laws of 2007, No. 93, item 623, amended) and the Regulation of the Minister of Energy of 6 March 2019 on detailed rules for the formation and calculation of tariffs and clearing in electricity trading (Journal of Laws of 2019 item 503 as amended). This order does not cover the provision of electricity distribution services.

Part I — the order covers the supply of electricity in a planned quantity of 13.389.909 kWh, from 01.01.2022 to 31.12.2023 (24 months) to the electricity consumption points in accordance with Annex No 1A to the SWZ. A detailed description of the object of the order, together with the list of electricity consumption points for Part I of the object of the order, is contained in Annex No 1A to the SWZ. The electricity consumption declared in the Annexes above shall be an estimate and shall only be used for the purposes of calculating the price of the Offer. As part of the execution of the contract, the Contractor is also responsible for trade balancing. The Contracting Authority shall provide for the possibility of exercising the right of the options, in the circumstances, the time limits and to the extent referred to below. In the course of implementation of the contract, the Contracting Authority reserves the right to increase by 2.008.487 kWh the total amount of energy specified in Chapter 3 (5) (a) of SWZ - in the scope of Part I of the object of the contract. For Part I of the object of the contract, the Contractor is obliged to have contracts in force throughout the period of the implementation of this contract with the Distribution System Operator (OSD), i.e. ENEA OPERATOR Sp. z o.o. and ENERGETYKA SA PKP operating on the territory of the Contracting Authority, allowing the conclusion of effective contracts and the sale of electricity through the distribution network of the DSO to the electricity collection points set out in Annex No 1A to the SWZ. The start of the supply of electricity will take place from 01.01.2022, but not earlier than the date of effective termination of current comprehensive service contracts or contracts for the sale of electricity or agreements binding the Ordering Party (Payers) on the time marked, and also not earlier than the date of entry into force of the contract for the provision of distribution services, following the implementation of the provisions of the Act of 10 April 1997 - Energy law and the implementing provisions of the procedure for changing the seller. The conditions shall apply separately to each electricity consumption point set out in Annex No 1A to SWZ. The Authorised Contracting Authority shall inform that for all electricity collection points, the seller change procedure shall be carried out once again. For all electricity consumption points set out in Annex No 1A to SWZ, there are fixed-term electricity sales agreements concluded with ENEA S.A. All tailored measurement and settlement systems (including for energy consumption points) electric, which have Bxx tariff groups) are in principle TPA. The Contractor shall fulfill the order for Part I of the subject of the contract under the terms and conditions set out in the contract template constituting Annex No. 9 to SWZZ.NOTE accordingly! The Contracting Authority stipulates that the above-mentioned contracts with the OSD Distribution System Operator shall hold the Contractor at the date of submission of tenders or at the latest on the date of the start of the supply of electricity.

Part II — the order covers the supply of electricity in the planned quantity of 14.017.637 kWh, from 01.01.2022 to 31.12.2023 (24 months) to the electricity consumption points in accordance with Annex No 1B to the SWZ. A detailed description of the object of the order, together with the list of electricity consumption points for this Part of the item of the order, is contained in Annex No 1B to the SWZ. The electricity consumption declared in the Annexes above shall be an estimate and shall only be used for the purposes of calculating the price of the Offer. As part of the execution of the contract, the Contractor is also responsible for trade balancing. The Contracting Authority shall provide for the possibility of exercising the right of the options, in the circumstances, the time limits and to the extent referred to below. In the course of implementation of the contract, the Contracting Authority reserves the right to increase by 2.102.646 kWh the total amount of energy specified in Chapter 3 (5) (b) SWZ - in the scope of Part II of the subject of the contract. For Part II of the object of the contract, the Contractor is obliged to have contracts in force throughout the period of the implementation of this contract with the Distribution System Operator (OSD), i.e. ENEA OPERATOR Sp. z o.o., operating on the territory of the Contracting Authority, enabling the conclusion of effective contracts and the sale of electricity through the distribution network of the DSO to the electricity collection points referred to in Annex No 1B to the SWZ. The start of the supply of electricity will take place from 01.01.2022, but not earlier than the date of effective termination of current comprehensive service contracts or contracts for the sale of electricity or agreements binding the Ordering Party (Payers) on the time marked, and also not earlier than the date of entry into force of the contract for the provision of distribution services, following the implementation of the provisions of the Act of 10 April 1997 - Energy law and the implementing provisions of the procedure for changing the seller. The conditions shall apply separately to each electricity consumption point set out in Annex No 1B to SWZ. The Authorised Contracting Authority shall inform that for all electricity collection points, the seller change procedure shall be carried out once again. ATTENTION! The Contracting Authority stipulates that the above-mentioned contracts with the OSD Distribution System Operator shall hold the Contractor at the date of submission of tenders or at the latest on the date of the start of the supply of electricity.
