1. The subject of the contract is the provision by the Contractor to the Contracting Authority of the following services: summer and winter maintenance of streets, pedestrian roads, parking lots and stops, emptying and washing street bins and liquidation of wild landfills in Siemianowice Śląskie.
2. The order was divided into two (2) parts.
2.1. Part 1: "Summer and winter maintenance of streets, pedestrian roads, car parks and stops in Siemianowice Śląskie".
2.2. Part 2: Emptying and washing street bins and liquidation of wild landfills in Siemianowice Śląskie'.
Summer and winter maintenance of streets, pedestrian roads, parking lots and stops in Siemianowice Śląskie1. Lot 1 of the contract is divided into two tasks:
a) Task 1: Summer maintenance of streets, pedestrian roads, parking lots and stops in Siemianowice Śląskie, hereinafter also referred to as "Akcja Lato" or "AL":
The subject of the task is the summer maintenance of streets, pedestrian roads, parking lots and stops in Siemianowice Śląskie, which is determined from March 1 to November 30. However, this period depends on the actual weather conditions. The Ordering Party reserves the right to extend or shorten the "Summer Action", depending on the weather conditions, with an accuracy of one day, one hour.
b) Task 2: Winter maintenance of streets, pedestrian roads, parking lots and stops
in Siemianowice Śląskie, hereinafter also referred to as "Akcja Zima" or "AZ":
The subject of the task is winter maintenance of streets, pedestrian roads, parking lots and stops in Siemianowice Śląskie, which is determined from December 1 to February 28/29. However, this period depends on the actual weather conditions. The Ordering Party reserves the right to extend or shorten the "Winter Action", depending on the weather conditions, with an accuracy of one day, one hour.
2. A detailed description of the subject of the contract in relation to Part 1 of the contract was included in Appendix No. 5 to the SWZ and in the draft provisions of the contract constituting Appendix No. 4a to the SWZ.
3. The Contractor is obliged to perform the contract on the terms and conditions described in the Draft provisions of the contract (Appendix No. 4a to the SWZ).

5.1. The Contracting Authority reserves the right to award contracts referred to in Article 214(1)(7) of the Act.
5.2. Orders will consist in repeating similar orders as basic orders, i.e. summer and winter maintenance of streets, pedestrian roads, parking lots in Siemianowice Śląskie and will be consistent with the subject of the basic contract.
5.3. The value of a similar order for Lot 1 of the order shall not exceed 50% of the net amount of the basic order.
1.4. A contract may be awarded provided that there is at least one
from the following situations:
a) in the event of exhaustion of the amount referred to in § 5 of the concluded contract,
b) if it is necessary to increase the frequency of icing removal and slippery roads on the roads,
(c)in the event of failure to conclude a contract for the service of summer and winter maintenance of streets, pedestrian roads, car parks and stops as a result of the settlement of an open procedure.
5.5.The award of the contract will be preceded by a procedure in the following procedure
single-source, including negotiations with the Contractor.
Emptying and washing street bins and liquidation of wild landfills in Siemianowice Śląskie1.The subject of the contract is the provision by the Contractor to the Ordering Party of a service consisting in emptying and washing street bins and liquidation of wild landfills
in Siemianowice Śląskie, in particular:
1) emptying street bins according to the List of street bins along with the frequency of their emptying constituting Appendix No. 6 to the SWZ and cleaning and collecting (during emptying) waste lying within a radius of 1 meter from the bins,
2) replenishing the feeders at the baskets for dog excrement into bags for collecting excrement in accordance with the List of baskets for dog excrement with feeders for bags, which is Appendix No. 7 to the SWZ,
3) washing street baskets owned by the Municipality of Siemianowice Śląskie (carried out each time at the request and within the time indicated by the Ordering Party),
4) removal of solid waste – liquidation of wild landfills (carried out each time at the request of the Contracting Authority and in the time consistent with the Contractor's offer, but not longer than 72 hours from notification),
5) cleaning the surface of municipal areas (carried out each time at the request and time indicated by the Ordering Party),
6) mowing ruderal vegetation along with cleaning the surface (carried out each time at the request and at the time indicated by the Ordering Party).
2.A detailed description of the subject of the contract in relation to Part 2 of the contract was included in the draft provisions of the contract constituting Appendix No. 4b to the SWZ and the List of street bins along with the frequency of their emptying (Appendix No. 6 to the SWZ) and the List of dog droppings baskets with bag feeders (Appendix No. 7 to the SWZ).
3.The Contractor is obliged to perform the contract on the terms and conditions described in the draft provisions of the contract (Appendix No. 4b to the SWZ).

5.1.The Contracting Authority reserves the right to award contracts referred to in Article 214 paragraph 1 point 7 of the Act.
5.2.Orders will consist in repeating similar orders as the basic orders, i.e. emptying and washing street bins and liquidation of wild landfills in Siemianowice Śląskie and will be consistent with the subject of the basic contract.
5.3.The value of a similar order for lot 2 of the order will not exceed 50% of the net amount of the basic order.
5.4.A contract may be awarded provided that there is at least one
from the following situations:
a) in the event of exhaustion of the amount referred to in § 3 of the concluded contract,
(b)where it is necessary to increase the frequency of emptying of street bins or to increase the amount of tonnes of waste to be disposed of as part of the decommissioning of wild landfills,
(c)in the absence of a contract for the emptying and washing of street bins and the liquidation of wild landfills as a result of an open procedure.
5.5.The award of the contract will be preceded by conducting a single-source procedure, including negotiations with the Contractor.
