The subject of the contract is the purchase of electricity for 2023 – 2024 to the Poznań – Ławica Sp. z o.o. Airport. The description of the subject of the contract and its scope is included in Appendix No. 1 to SWZ – Description of the subject of the contract (OPZ).

The Contracting Authority does not allow the submission of partial, variant tenders, does not provide for the conclusion of a framework agreement, the award of contracts referred to in Article 214(1)(7) and (8) of the PPL, the Contractors to carry out a local inspection or to check the documents referred to in Article 131(2)(2) of the PPL, settlements in foreign currencies, an electronic auction, reimbursement of costs of participation in the procedure, employment requirements based on an employment relationship or other requirements referred to in Article 96 of the PPL shall not allow the submission of offers in the form of electronic catalogues or the attachment of electronic catalogues to the offer.

The contracting authority did not divide the contract into parts due to the fact that such a division would threaten excessive technical difficulties and excessive costs of performing the contract. The need to coordinate the activities of the different economic operators performing the different parts of the contract could seriously jeopardise the proper performance of the contract. The failure to divide the contract was therefore dictated by technical, organizational and the nature of the subject of the contract. Dividing the contract into lots would not increase competitiveness in the sector of small and medium-sized enterprises. The scope of the contract is a typical scope, enabling contractors from the group of small and medium-sized enterprises to submit a tender.
