The subject of the order is the delivery of brand new, free from legal and physical defects equipment for digitizing library resources: computer hardware, software and scanners. The subject of the order is separated into 2 lots. Further information regarding the order under Lot 1 and Lot 2 (including the types of equipment making up the lot) are given below in the announcement, with detailed and comprehensive information in the Terms of Reference. By the term "Terms of Reference" used in the notice should be understood the documents of this contract forming the specification referred to in Article. 36 of the Polish Act - Public Procurement Law (hereinafter referred to as "PPL Act"). These proceedings are conducted under an open tender within the meaning of the PPL Act. The proceeding does not foresee (or will not) the conclusion of a framework agreement or the establishment of a dynamic purchasing system. The use of electronic auctions when selecting the best bid is also not foreseen.
1. The subject of this order is the delivery of brand new computer hardware and software free from legal and physical defects.
2. Technical and scope description of the subject of this contract (technical, functional parameters, quantity and other minimum properties required by the Employer for the individual equipment making up the delivery item referred to in paragraph 1 is included in Annex 2 to the ToR).
3. The scope of this order (delivery performance referred to in the above provisions) includes a minimum of:
1) sale and delivery to the Employer of the equipment offered (including, if necessary, making his customs declaration for entry and use in the territory of the Republic of Poland); The equipment supplied must be brand new, not used in any way, and not used for presentation or display purposes, and may not come from resale and must be marked by the manufacturer in such a way that the product and manufacturer can be identified;
2) in relation to software, delivery of equipment means the provision of a license to use the software by the contracting authority in accordance with its intended use and to the extent specified for the software in Annex 2 of the Terms of Reference (as part of the description of the subject of the contract for task 1) as well as any other computer programs, if such programs will be the subject of the offer in the task or components necessary to use the equipment offered in the task;
3) providing the Employer with a warranty for the equipment offered, delivered and issued to the Employer in the task, while it is required to provide a warranty for the equipment including also providing future users with the equipment offered with remote technical support for a period of not less than:
a) 36 months from the date of issuing to the Employer equipment in the task,
4) obtaining and issuing to the Employer relevant documents related to the use of equipment, including the exercise of rights under the warranty referred to in the above item (declared in the offer).
4. The scope and manner of fulfilling the benefits referred to in para. 3 above, the type and manner of presenting the documents referred to in para. 3 point 4) above - provides Model Contract, Annex 9 of the ToR.
5. As for the entire contract, so in relation to this Part 1 of the contract, the Employer neither requires nor allows the submission of a variant offer within the meaning of Art. 2 point 7 of the PPL Act.
