The object of the framework agreement is the ordinary and extraordinary maintenance of public parks.
The assignment will be carried out through an open procedure for the conclusion of a framework agreement with a single economic operator pursuant to art. 54, paragraph 3, and with application of the criterion of the most economically advantageous offer identified on the basis of the best value for money, pursuant to art. 54 and 95 of Legislative Decree 18.4.2016, n. 50 - Code of public contracts.
The location of the service is the territory of the Municipality of Barberino del Mugello.
This open procedure, pursuant to the combined provisions of art. 60 and 54, paragraph 3, Legislative Decree no. 50/2016, concerns the identification of a single economic operator with which to enter into the Framework Agreement for the performance of ordinary and extraordinary maintenance of public green areas owned or available to the Municipal Administration of Barberino di Mugello, with reduced environmental impact, compliant with the Decree of the Ministry of the Environment, protection of the territory and the sea, published in GURI 17.1.2014 general series n. 13, CAM for the assignment of the public green management service.
The tender mainly consists of the ordinary maintenance of parks, gardens, green areas, street trees, roadsides, flower beds and anything else that makes up the municipal public green heritage within the Bilancino area, including the maintenance of equipment and facilities therein. contained, in addition to a limited amount of extraordinary maintenance interventions that can be commissioned according to the provisions and conditions established by the special tender specifications. It follows that the contracting station may base the awarding of individual contracts for the provision of the aforementioned services on the basis of the conclusion of this Framework Agreement and for all its duration and validity.
The Framework Agreement therefore contains the general rules inherent to the performance of the services that will be specifically and subsequently identified and entrusted to the economic operator with specific implementation contracts. The Framework Agreement must therefore be understood, with respect to individuals and any «application contracts», as a «regulatory contract».
The stipulation of the Framework Agreement will not be a source of any obligation for the Municipality of Barberino di Mugello against the contractor. The Contractor, on the other hand, is bound to perform the services which, based on the signed Framework Agreement, will be requested from time to time by the contracting station.
The total amount of the framework agreement is EUR 522 114.77 plus VAT, divided as follows:
- EUR 461 669.40 as total amounts of the service subject to a reduction,
- EUR 14 278.43 for non-discounted security charges,
- € 46.166.94 as the amount of the extension for a maximum of 2 months pursuant to art. 106, paragraph 11 of Legislative Decree no. 50/2016.
