The subject of the contract is a comprehensive supply of high-methane natural gas (group E) amounting to total for the basic contract covering all buyers 1.786.467 kWh — according to the Statement of gas collection points, which is Annex 4 to the SWZ.
Group E gas shall be delivered 24 hours a day to the receiving and receiving points listed in the Summary of gas collection points, which is Annex 4 to the SWZ, which is an assembly of gas equipment used to connect the internal network, owned by the Contracting Authority to the gas network system operator.
2. The Contractor shall be obliged to ensure quality standards of service of the Ordering Party in accordance with the applicable energy law in this area. Should ensure continuity of supply without any interruption except as described in the Energy Law Act, IRIESD, tariff and have a provision guaranteeing continuity of supply.
3. Property of gas fuel passes to the Ordering Party after measuring at the exit from the gas meter.
4. The volume of gas intake is estimated in total for the basic contract covering all buyers at 1,786,467 kWh for a period of 12 months for the facilities listed in the Statement of Gas Collection Points, which is Annex 4 to the SWZ. The estimated demand for gaseous fuel has been accepted to calculate the estimated value of the contract, which may deviate from the actual use of gaseous fuel and cannot in any case be the basis for any claims on the part of the Contractor. The projected gas consumption is indicative, because the quantity that will be delivered to the Ordering Party cannot be determined in advance and does not constitute an obligation on the part of the Contracting Authority to purchase gaseous fuel in the specified quantity.
5. In the course of the execution of the contract, the Contracting Authority shall be entitled to exercise the option referred to in Article 441 of the Polish National Procedure Act, in accordance with the rules set out in Chapter IV of the SWZ.
6. Settlements for the distribution of gaseous fuel will take place on the basis of current indications of the measurement and settlement system (data provided by the DSO), while for tariffs with the number of readings in year 1 and 2 it is possible to settle on the basis of estimated consumption. In this case, the final settlement for the given settlement period will be based on the billing invoice issued by the Contractor after obtaining measurement data from the DSO, which will take into account the amount of gas fuel actually collected by the Customer.
Issuance by the Contractor of preliminary invoices for consumption points exceeding 110 kWh/h on the basis of the projected gaseous fuel consumption and the billing invoice for gas fuel collected issued at the end of the billing period, provided that amounts are taken into account on the billing invoice resulting from preliminary invoices, it is possible only at the individual request of a given Contracting Authority (Buyer).
7. Addresses of collection points, tariff groups, contract data, consumption and other necessary information are included in the Summary of gas collection points, which is Annex 4 to the SWZ.
8. The Contractor undertakes to carry out the procedure for changing the seller of gaseous fuels, in accordance with the Distribution Network Movement and Operation Instructions (IIESD) for the provision and use of gas fuel distribution services. Data on contracts are contained in the Statement of gas intake points, which is Annex No. 4 to the SWZ.
9. The supplied natural gas should comply with legal requirements and technical parameters in accordance with the provisions of the Act of 10 April 1997 Energy Law and implementing acts issued pursuant to it and the Act of 16 February 2007 on Petroleum, Petroleum Products and Gas Terrestrial and the rules for dealing with situations of State fuel security risks and disturbances on the oil market and certain other laws.
10. At the request of the selected Contractor, the Contracting Authority shall provide the necessary data to carry out the procedure for changing the seller in the electronic version of Excel immediately after signing the contract.
11. After the selection of the Contractor, comprehensive agreements will be concluded, one for the Municipal Municipality (covering all recipients for whom the Municipality is the buyer) and separate for commercial companies (4 items).
