1) The subject of the contract is the performance of cleaning services for real estate managed by the Department of Housing Resources of the Ursynów District m.st. Warsaw, with a detailed description of the subject of the contract being specified by:
- Description of the subject of the contract constituting Annex No. 1 to the SWZ, which will be Annex No. 1 to the contract;
- the proposed provisions of the contract constituting Annex 5 to the SWZ;
1) The subject of the contract is the performance of cleaning services for real estate managed by the Department of Housing Resources of the Ursynów District m.st. Warsaw, with a detailed description of the subject of the contract being specified by:
- Description of the subject of the contract constituting Annex No. 1 to the SWZ, which will be Annex No. 1 to the contract;
- the proposed provisions of the contract constituting Annex 5 to the SWZ;
2) Obligations under the social clause
1. The contracting authority in the proceedings in question applies the social clause pursuant to Article 95(1) of the Act of 11 September 2019. Public procurement law.
2. The Contractor declares that activities related to the implementation of the subject of the contract will be performed by persons employed under an employment contract within the meaning of Article 22 § 1 of the Act of 26 June 1974 - Labour Code (Journal of Laws 2022.1510, i.e.) by the Contractor or Subcontractor.
3. The condition referred to in paragraph 2 shall be fulfilled by employing new employees on the basis of an employment contract or by appointing already employed persons to perform the contract, performing the following activities during the performance of the contract, i.e. cleaning services of real estate owned by the m.st of Warsaw managed by the Department of Housing Resources for the Ursynów District, i.e. cleaning: external surfaces, including pedestrian routes with
with snow removal from autumn to spring and emptying of street bins and animal excrement bins, indoor surfaces and green areas.
4. Detailed requirements for employment on the basis of an employment relationship, in the circumstances referred to in Article 95 of the Act, in particular the method of verifying the employment of persons under an employment contract, the Contracting Authority's rights to control the Contractor's compliance with the above-mentioned requirements and sanctions for non-compliance with them are specified in the draft provisions of the contract constituting Annex 5 to the SWZ.
