1. The subject of the contract is the performance of activities and works resulting from the scope of level 4 revision repair of the maintenance of a railway vehicle (P4) for 2 pcs. type 308B vehicles of the EN81 series, hereinafter referred to as the Vehicles and other activities indicated by the Ordering Party covered by the right of option.

2. As part of the basic contract, the Contractor will be obliged to perform the work always performed during each P4 level revision repair in accordance with the guidelines set out in section 5 of the OPZ (Description of the subject matter of the contract).

3. The Contractor, as part of the right of option, will be obliged to renovate the passenger compartment seats, wheelchair backrests and armrests, as well as replace the driver's seats with new ones available in the Vehicles. Detailed guidelines on the performance of activities covered by the option right can be found in Appendix 1 to the Description of the Subject of the Contract (OPZ).

3. 4. A detailed description of the optional contract along with information on the rules for awarding the optional contract are specified in the provisions of the agreement (Appendix No. 4 to the Terms of Reference, paragraph 10.1-7).

5. The Contracting Authority informs that in 2021 it modernized the Dynamic Passenger Information System, the driver's timetable, GPS location, GSM data transmission, driver identification along with the following systems: public address and intercoms, video monitoring, passenger flow counting and Internet access on both vehicles.

6. The Contractor is obliged to perform the subject matter of the contract in accordance with:

1) Documentation of the Maintenance System (DSU) of the electric rail bus type 308B;

2) Technical and Operational Documentation (DTR) of the electric rail bus type 308B;

3) Technical Conditions of Execution and Acceptance (WTWiO) of the electric rail bus type 308B;

4) standards (European, Polish, company and industry standards) and other standardization documents (m.in. UIC charters) referred to in the technical documentation listed in section 5 points 1 – 5 and related documentation in the form currently in force;

5) safety rules resulting from the Rail Transport Act (i.e. Journal of Laws of 2021, item 1984, as amended) and the Regulation of the Minister of Infrastructure of 12 October 2005 on general technical conditions for the operation of railway vehicles (Journal of Laws of 2016, item 226, as amended).

6) currently applicable standards and regulations resulting from the current legal status of the European Union;

8. The Contracting Authority prohibits transferring, duplicating, saving on data carriers and using the documentation referred to in paragraph 6 in whole or in part for purposes other than the performance of the subject matter of the contract.

9. The Contracting Authority allows for the possibility of conducting a site inspection of the Vehicles listed in paragraph 1 in order to make a preliminary estimate of the scope of work and the costs associated with it before submitting an offer.
