Maintenance of road technical infrastructure in the City of Łódź

4.1 The subject of the contract is the maintenance of road technical infrastructure consisting in its ongoing maintenance in constant technical efficiency and replacement of damaged elements and devices with new ones or transferred by the Ordering Party, in accordance with the Annex to the Regulation of the Minister of Infrastructure of 3 July 2003 on detailed technical conditions for road signs and signals and road safety devices and conditions for their placement on roads (Journal of Laws of 3 July 2003 on detailed technical conditions for road signs and signals and road safety devices and conditions for their placement on roads (Journal of Laws of 3 July 2003 on detailed technical conditions for road signs and signals and road safety devices and conditions for their placement on roads (Journal of Laws of 3 July 2003 2019, item 2311, as amended). The subject of the contract is the maintenance of road technical infrastructure consisting in its ongoing maintenance in constant technical efficiency and replacement of damaged elements and devices with new ones or transferred by the Ordering Party, in accordance with the Annex to the Regulation of the Minister of Infrastructure of 3.07.2003. on detailed technical conditions for road signs and signals and road safety devices and conditions for their placement on roads (Journal of Laws of 2019, item 2311, as amended). The scope of maintenance of road technical infrastructure includes basic maintenance, additional maintenance.

A detailed description of the subject of the contract can be found in Annex 1 to the SWZ. The order was not divided into parts. The contracting authority withdrew from dividing the contract into lots, due to the fact that the contract is a uniform whole and interconnections between individual scopes for technical, organizational and economic reasons. Dividing into parts would negatively affect safety by extending the lead time in crisis situations. The need to coordinate the activities of different economic operators performing different parts of the contract could jeopardise the proper performance of the subject-matter of the contract. This applies especially to emergency works, where the Contractor must react immediately by setting up appropriate signs or BRD devices and fill in the gaps in the marking on an ongoing basis. Failure to divide the contract into lots will not violate the principle of fair competition and will not limit the possibility of applying for the contract for smaller entities. Contractors belonging to SMEs will have no difficulty in implementing it as a whole. Pursuant to Article 95 of the PPL, the Contracting Authority requires the Contractor or Subcontractor, on the basis of an employment contract, to employ 4 persons performing the activities indicated by the Contracting Authority in the scope of contract performance, if the performance of these activities consists in performing work in the manner specified in Article 22 §1 of the Act of 26.06.1974 – Labour Code (Journal of Laws of 2022, item 1510, as amended), i.e.: a) operation of means of transport for transporting equipment and other devices of road technical infrastructure participation in the process of road marking;b) operation of machines necessary to perform the subject of the contract; (c)securing the site during the work; (d)installation and dismantling of signs, sign carriers and road safety devices.

The Contracting Authority requires that all activities consisting in the actual performance of the above-mentioned services, unless they are (will be) performed by a given person as part of his business activity, be performed by persons employed by the Contractor or subcontractor on the basis of an employment contract within the meaning of the Act - Labor Code (indicate activities that consist in performing work in the manner specified in Article 22 § 1 of the Labor Code). The scope of work of persons performing activities in the field of contract performance and the method of documenting the employment of these persons and the rights of the Contracting Authority in the scope of control of compliance by the Contractor with the requirements and sanctions for failure to meet them are specified in the description of the subject of the contract (Annex No. 1 to the SWZ) and in the model contract (Annex 9 to the SWZ).

The contracting authority provides for the award of a contract consisting in the repetition of similar services in accordance with Article 214(1)(7) of the Act.

a) The subject of the contract is the maintenance of road technical infrastructure consisting in its ongoing maintenance in constant technical efficiency and replacement of damaged elements and devices with new ones or transferred by the Contracting Authority, in accordance with the Annex to the Regulation of the Minister of Infrastructure of 3 July 2003 on detailed technical conditions for road signs and signals and road safety devices and conditions for their placement on roads (Journal of Laws No. 220, of 23 December 2003, item 2181).b)The contracting authority provides for the possibility of using a contract consisting in the repetition of similar services up to the value of 50% of the basic contract.
