1. Winter road maintenance in the city and municipality of Pszczyna in the season 2022/2023 includes:
• snow removal and combating winter slipperiness on roads, streets, bus stop bays;
• snow removal and combating winter slipperiness on sidewalks, parking lots;
• removal (removal) of snow from roads, streets.
2. The detailed scope of the subject of the contract is specified in Annex No. 1 to the SWZ, i.e. the Detailed Technical Specification. The list of roads, pavements and parking lots subject to winter maintenance and sweeping after the winter season is specified in Annexes No. 8, 9, 10 and 11 to the SWZ.

• snow removal and combating winter slipperiness on sidewalks, parking lots;
• removal (removal) of snow from roads, streets.
2. The detailed scope of the subject of the contract is specified in Annex No. 1 to the SWZ, i.e. the Detailed Technical Specification. The list of roads, pavements and parking lots subject to winter maintenance and sweeping after the winter season is specified in Annexes No. 8, 9, 10 and 11 to the SWZ.
3. Winter road maintenance services in the city of Pszczyna will be provided by plough carriers, in accordance with the submitted offer.
4. The Ordering Party requires the installation in the technical space of Plough Carriers and carriers with a sandblasting machine, which will perform work in the city of Pszczyna, locating devices providing current and archival information from the last 60 days, information about the position of the vehicle along with its identifier. The locating device must ensure that the location data is cached in the absence/disappearance of GSM coverage and transmitted immediately after the connection is recovered. The Contractor shall provide the Ordering Party with access data for the location system with plough carriers.
5. The Contractor shall provide an adequate amount of equipment for snow removal and slipperiness control and an appropriate number of people with appropriate qualifications necessary to perform the contract.
6. As part of the remuneration, the Contractor is obliged to purchase and store an appropriate amount of chemical and roughening materials used to combat slipperiness.
7. The Contractor is obliged to have a dispatching point with access to information on the actual location of vehicles participating in the winter action and having direct communication with each of the vehicles and with the Ordering Party.
8. In the event that any claims of third parties arising from the services performed by the Contractor are directed against the Ordering Party, the Contractor shall assume all liability and conduct of the case for the claim and shall satisfy such claims on its own, if they are justified. The Contractor shall immediately notify a third party of the takeover of the claim.
9. The Ordering Party shall not recognize any claims of third parties arising in connection with the services provided by the Contractor, in respect of which the Ordering Party would be entitled to a recourse claim against the Contractor.
10. The Contractor bears full responsibility towards residents and third parties for damage caused during the performance of the service, in particular it is liable for traffic damage resulting from the participation of vehicles in road traffic and damage to property of the owners of real estate adjacent to the snow removal areas, as well as other damage.
11. The subject of the contract is financed from the budget of the Municipality of Pszczyna.
