1. The subject of the contract shall be described by the following names and codes of the common procurement vocabulary (cpv): 09.30.00.00-2 - electricity, heat, solar and nuclear. 2. The subject of the contract is the supply of electricity to organizational units of the Jerzmanowice - Przeginia Commune and other entities for the purposes of a joint contract conducted pursuant to Article 38(1) of the PPL 3 Act. The expected amount of electricity supplied during the delivery period (from 1 January 2023 to 31 December 2023) is 1430,556 MWh. 4. The contracting authority is considering the construction of RES installations in further locations. The Contractor undertakes to repurchase the electricity generated in the Ordering Parties' installations at the weighted average monthly BASE price for the Day-Ahead Market published on the www.tge.pl in the "Monthly Report" by the Polish Power Exchange (TGE) for a given billing cycle according to the model contract commonly used by the Contractor. 5. The subject of the contract has been divided into two parts, i.e.: Part No. 1 – lighting of public space; The subject of the contract is the supply of electricity to: Jerzmanowice - Przeginia Municipality. Expected amount of electricity supplied during the delivery period, i.e. from 1 January 2023 to 31 December 2023 is 520,515 MWh. Part No. 2 – electricity supply of facilities The subject of the contract is the supply of electricity to: organizational units of the Jerzmanowice - Przeginia Municipality, as well as the District and Municipal Public Library in Jerzmanowice and the Municipal Cultural Center. Expected amount of electricity supplied during the delivery period, i.e. from 1 January 2023 to 31 December 2023 is 910,041 MWh. A detailed description of the subject of the contract and the conditions for its implementation are contained in the Description of the subject of the contract (Annex No. 14 to the SWZ), Draft Contracts (Annexes No. 1a, 1b and annexes thereto.) 6. The implementation of the delivery does not require the occurrence of employee subordination between the Contractor or subcontractor and the persons employed by these entities within the meaning of the provisions of labor law, therefore the Ordering Party does not set any requirements within the scope of Article 95 of the PPL Act.

Part No. 2 – electricity supply of facilities The subject of the contract is the supply of electricity to: organizational units of the Jerzmanowice - Przeginia Municipality, as well as the District and Municipal Public Library in Jerzmanowice and the Municipal Cultural Center. Expected amount of electricity supplied during the delivery period, i.e. from 1 January 2023 to 31 December 2023 amounts to 910.041 MWh.
