Maintenance and conservation of street greenery in the Bielany District m.st Warsaw for the years 2022 – 2023.

1. The subject of the contract is the maintenance and maintenance of street greenery in the Bielany District and includes:

a) maintaining cleanliness in street green belts (surface garbage collection),

b) care of low greenery (weeding of bushes with digging the ground and care and form shaping cuts, debarking, preventive spraying).

c) care of tall greenery, including felling of trees,

d) mowing and renovation of lawns,

e) spring, autumn raking,

f) planting trees and shrubs,

g) watering,

h) repair of the existing fence type ZOM or its supplementation,

i) review the stand of trees in the road lanes of municipal and internal public roads (Annexes No. 3 and 4) in terms of the health status of trees, in particular trees threatening the safety of life and property, and draw up in writing the needs for the care or felling of trees in the first month of validity of the contract.

2. In the area covered by the scope of works there is waste with codes – 02 01 03 – waste plant mass and 20 03 01 – non-segregated (mixed) municipal waste

3. Social clauses

Pursuant to Article 95(1) of the PPL, during the term of the contract, the Contractor undertakes to direct by itself or the Subcontractor on the basis of an employment contract employees employed in the performance of the following activities:

a) surface cleaning,

b) care of low and high greenery, including felling of trees,

c) mowing and renovation of lawns,

d) spring and autumn raking,

e) planting trees and shrubs,

f) watering

The term "employed" should be understood as newly employed as well as already employed employees) on the basis of an employment contract in the manner specified in Article 22 paragraph 1 of the Act of 26 June 1974 – Labor Code (Journal of Laws of 2020, item 1320)

The method of documenting the employment of the persons referred to above, the Ordering Party's rights to control the Contractor's compliance with the requirements referred to above and sanctions for non-compliance with these requirements are specified in the draft provisions of the contract, constituting Annex 4 to the SWZ.

4. Participation of electric or natural gas vehicles in the performance of the contract

In connection with Article 68(3) of the Act of 11 January 2018 on electromobility and alternative fuels (Journal of Laws of 2022.1083), the Contractor undertakes to provide the service using at least 1 electric or natural gas vehicle within the meaning of Article 2(33) of the Act of 20 June 1997 – Road Traffic Law.

5. A DETAILED DESCRIPTION OF THE SUBJECT OF THE CONTRACT shall also specify:

 Price form constituting at the same time the scope of work to be performed – constituting Annex 2 to the SWZ;

 Technical conditions for the performance of the contract – constituting Annex 1 to the SWZ;

 List of roads (public municipal and internal) – constituting Annex 3 to the SWZ;

 Draft provisions of the agreement – constituting Annex 4 to swz.
