The subject of the contract is the preparation of a land development project together with an architectural and construction design (construction project) and the preparation on their basis of a functional and utility program for the construction of a two-level rail-road intersection in exchange for the liquidation of a single-level intersection of railway lines number 61 Kielce – Fosowskie and number 143 Kalety – Wrocław Popowice along Częstochowa Street in the city of Lubliniec together with the construction of an underground passage in trace of the current rail-road crossing - along with the author's supervision.

1. The contract shall take into account, inter alia:

1) in the calculation of the costs of the task, the need to buy land, division of real estate, demolition of facilities, restrictions on train traffic (track closures, speed limits of trains),

2) staging works based on arrangements with PKP Polskie Linie Kolejowe S.A.

3) division of costs to be incurred between PKP (scope of works on PKP areas) and the Municipality of Lubliniec,

4) performing additional geological surveys along with the development of a geotechnical opinion, and if necessary also geological and engineering documentation,

5) designing an underground passage for pedestrians under the railway tracks in the place of the current road-railway crossing (solution not included in the attached concept). The crossing should be adapted to serve people with reduced mobility through the installation of passenger lifts (with parameters enabling the handling of persons with reduced mobility and the transport of bicycles and prams). The pedestrian route in the aisle must be adjusted to allow bicycles and prams to be carried out.

6) a road in a road tunnel adapted to the movement of motor vehicles and bicycles,

(7) design documentation must be drawn up using the principles of universal design, taking into account the needs of all users, regardless of their limitations in mobility and perception, allowing full accessibility for all persons with reduced mobility, the elderly and children; in particular, this applies to communication routes, passenger lifts and information systems, boards and other visual information elements, which must be adapted to persons with special needs, including the blind and visually impaired; The designed devices must take into account the current guidelines of the competent minister for funds and policy regarding the implementation of equality principles within the framework of European funds.

2. The scope of the dossier shall include:

1) construction project (land development project and architectural and construction design) with all arrangements and decisions,

2) summary of costs,

3) obtaining all necessary arrangements, opinions and conditions of relevant institutions, including, m.in. all PKP companies and plants in the scope of conditions for the reconstruction of railway equipment and arrangements for design solutions,

4) taking into account in the development of collision removal within the boundaries and vicinity of the area covered by the project,

5) obtaining maps for design purposes,

6) performance of geological surveys along with the development of geotechnical documentation for the needs of the designed task, and if necessary also geological and engineering documentation,

7) development of a water law survey along with obtaining a water permit,

8) development of an information sheet on the project along with obtaining a decision on the environmental conditions of the project,

9) preparation of a report on the project's impact on the environment (if necessary),

10) preparation of materials together with the application, necessary to obtain a permit for the implementation of a public purpose investment, in accordance with the provisions of the Act of 10 April 2003 on specific principles of preparation and implementation of investments in the field of public roads (Journal of Laws of 2023, item 162),

11) development, on the basis of the prepared construction project, of a functional and utility program for the construction of a two-level rail-road intersection in exchange for the liquidation of a single-level intersection of railway lines number 61 Kielce – Fosowskie and number 143 Kalety – Wrocław Popowice along Częstochowa Street in the city of Lubliniec together with the construction of an underground passage in the wake of the current rail-road crossing, which will be used to describe the subject of the contract in the proceedings for award of a public contract for the execution of construction works,

12) development of planned costs of design works (executive designs, technological designs) and planned costs of construction works.
