Description:
Receiving and landscaping of municipal waste from properties on which residents reside located within the City of Otwock.

1.2. The subject of the contract is specified in detail in the application and draft contract.

2.1. Under this contract, the Contractor is obliged to manage waste classified with codes (indicated in Table 1.)

2.5. Delivery of municipal waste collection schedules to the Ordering Party's Headquarters.

2.6. Deliver waste bags referred to in point 8.7. to all real estate and the headquarters of the ordering party,

2.7. In January and February for the collection and development of Christmas trees issued by residents in full, from the property or PGO from single-family and multi-apartment buildings.

3. Declarations by the contractor

1. The Contractor declares that it has the necessary authorizations and technical and personal potential to perform the subject of the contract, in particular:

1) entry in the register of regulated activities referred to in Article 9b of the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (Journal of Laws of 2022, item 2519), kept by the President of the City of Otwock;

2) waste collection permit referred to in Article 41 of the Waste Act of 14 December 2012 (Journal of Laws of 2022, item 699)

3) entry in the register referred to in Article 49 of the Act of 14 December 2012 on waste, kept by the Marshal of the Voivodeship in the field of waste transport;

4) entry in the register referred to in Article 49 of the Act of 14 December 2012 on waste, kept by the Marshal of the Voivodeship in the scope of collection of waste electrical and electronic equipment, unless the permit referred to in point 2) does not include the collection of waste electrical and electronic equipment;

5) concluded an agreement with the Municipal Waste Treatment Installation for the receipt of mixed municipal waste, sorting residues, biodegradable waste, including green waste, collected from the owners of real estate where residents live, unless it is the owner of the installation in question.

2 The Contractor undertakes to comply with the requirements set out in paragraph 1 throughout the duration of the contract,

3. The Contractor declares that he has read the content of the information clause on the processing of personal data, in force in the Otwock City Hall, which is part of the contract.

4. Obligations of the Contractor

1. The Contractor undertakes to perform all obligations arising from the contract and the tender specifications within the offered offer price,

2. The Contractor undertakes to perform its duties in accordance with the applicable provisions of law, including:

1) the Act of 13 September 1996 on maintaining cleanliness and order in municipalities and implementing regulations issued on its basis;

2) the Act of 14 December 2012 on waste;

3) the Environmental Protection Law of 27 April 2001;

4) Provincial Waste Management Plan for Mazovia,

and in accordance with the current resolutions of the Otwock City Council:

1) regulations for maintaining cleanliness and order adopted by a resolution of the Otwock City Council,

2) a resolution on establishing the detailed manner and scope of providing services in the field of collecting municipal waste from property owners and managing this waste,

3) and resolutions updated on the basis of applicable regulations.

3. The Contractor undertakes to collect waste from the property in accordance with the schedules approved by the Contracting Entity referred to in point 11

4. When collecting waste from the property, the Contractor is obliged to each time check the type of waste in terms of its compliance with the intended container or bag.

5. The Contractor is strictly forbidden to mix with each other individual types of waste referred to in point 2.1 (indicated in Table 1.)

6. For the duration of the implementation of the Subject of the contract, the Contractor is obliged to purchase and hand over 50 containers free of charge at the request of the Contracting Authority in the number, colour and capacity indicated by the Contracting entity - half of which will be containers with a capacity of 1100l, which after handing over will become the property of the municipality.

7. The Contractor is obliged to dispose of a pool of 200 containers with capacities and colours described in point 8, which at the request of the Contracting Authority and for a fee specified in 6.8 will (...)
