Open house vehicle procurement, i.e. the opportunity to participate in individual purchases of leased vehicles by the district clinics of Middle Franconia. The district clinics of Middle Franconia intend to procure vehicles according to different specifications (individual business vehicles, pool electric vehicles, minibuses, etc.). Procurement is made according to specifications on a case-by-case basis and non-exclusively. The present announcement does not lead to a contract award, but merely provides the opportunity to participate in individual awards.
Interested companies can express their interest using the above email address and then be invited to submit an offer on a case-by-case basis. Specifications can be added/corrected during the entire project phase. The open-house procedure can be limited in time by the district clinics of Middle Franconia.
The district clinics of Middle Franconia (BKM) intend to acquire vehicles of different classes by concluding leasing contracts. Interested companies can request further information from the position in accordance with Section I. Specifications and procedures can be added/corrected by BKM during the entire open house process.
The following procedure is envisaged:
- Interested parties can first request an expression of interest form and information on the non-binding forecast purchases.
- Companies that have submitted the expression of interest form are invited to submit tenders for individual purchases of leased vehicles. There is no entitlement to the conclusion of a contract.
- The form can be submitted at any time, and withdrawal is also possible at any time.
The opportunity to express interest is not limited by a time limit (open house proceedings, see also judgment of the European Court of Justice (ECJ) of 2.6.2016, case no. C-410/14), in particular, the period specified in Section IV.3.4) is not applied, this is only due to the formal requirements of the publication form. However, the procedure can be terminated by BKM at any time.
The present announcement does not concern the award of a public contract. This announcement does not initiate a formal award procedure. The process name “open procedure” used in this notice is due to the requirements of the publication form. Its use, the use of the “TED” platform and the entries in the form do not entail any submission to public procurement regulations that are not mandatory by law.
There is therefore no legal claim to participate in the open-house procedure and no legal protection, in particular no legal protection under public procurement law. The present announcement serves as broadly as possible to inform interested brokers and potential providers of leasing vehicles and is only made on the open procedure form in the absence of other suitable forms.
