5. Details about the tariff group, forecast gas consumption over a 24-month period, and contracted capacity in relation to individual consumption points are described in Annex 1 to the ToR. To determine the projected gas consumption in kWh, a conversion factor of 11.018 kWh / m was adopted 3 . Monthly gas consumption in meters 3 in 2018, broken down into tapping points, is indicated in Annex 4 to the ToR. At the same time, in Annex 5 to the ToR, the Employer stated gas consumption in 2018 in m 3 broken down into tariffs and individual months. Whereas in Annex 6 to the ToR, the Employer gave the forecast gas consumption in 2020 in m 3 , by month, broken down by tapping points. In addition, the Employer forecasts that in 2021 the same amount of gas will be used as in the previous year. The ordering party is exempted from the duty to pay excise duty, therefore the offer should include the prices of gaseous fuel exempt from excise duty. If the need arises, declarations regarding the destination of the purchased gas in relation to all of the Employer's facilities for the purposes of excise duty will be forwarded to the Contractor before signing the contract. The indicated consumption of natural gas is estimated and indicative, which is used only for valuation and then comparison of offers, and as a consequence does not constitute the Purchaser's obligation to purchase gas in the given amount. This amount may decrease during the contract period, and the settlement will be based on the actual gas consumption in individual facilities, as indicated by the meters at the unit price resulting from the Contractor's offer.

Deliveries and distribution services will be carried out under the conditions set out in the Act of 10.4.1997 Energy Law and executive provisions to the Act and in accordance with the provisions of the DSO tariff. The quality parameters of gaseous fuels are regulated by the provisions of the Energy Law, executive acts (in particular the Regulation of the Minister of Economy of 2.7.2010 on detailed conditions for the functioning of the gas system, consolidated text, Journal of Laws 2018 item 1158) and Polish standards.
