Description:

The subject of the contract is the modernization of municipal mixed and separately collected waste sorting installations. The contract will be carried out by the Contractor in the "Design and build" formula.

1. The subject of the contract is the modernization of municipal mixed sorting and separately collected waste sorting installations. The contract will be carried out by the Contractor in the "Design and build" formula, as part of the following parts:

1) First, the Contractor shall prepare and present to the Employer for its approval a detailed material and financial schedule, construction project, technological design for the first stage, referred to in PFU, technological design for the second and final stage, referred to in PFU - " Design part ".

2) Delivery and assembly of optopneumatic separators.

3) The construction and assembly part includes, in particular, repair and modernization of the Installation in the existing hall, in particular disassembly of the NIR 4 optopneumatic separator, modernization of the charge and discharge of the ballistic separator intended for the division of plastics separated by the optical separator into so-called 2D (flat-light) and 3D (spatial-heavier) fraction, assembly of complete technological equipment, change of applied construction solutions limiting the availability of sorting installations, ("Construction and Assembly Part").

4) Performing operational tests, the purpose of which is to check the full compliance of all Installation parameters with the Employer's requirements (in relation to meeting the performance and quality requirements of built-in devices) specified in the Terms of Reference ("Test Run"). The Test Run will be carried out no later than to the one indicated in § 6 para. 1 point 4) of the Agreement. The detailed scope of activities under the Trial Movement is specified in the ToR.

2. The commencement of the Construction and Assembly Part depends on the Purchaser's prior acceptance of the Design Part, and the commencement of the Testing Movement depends on the prior acceptance of the Construction and Assembly Part by the Employer. Description of the Installation Modernization, including the technical parameters of the Installation, requirements regarding the efficiency and quality of the Installation and how to assemble the elements constituting the Installation in the Plant, is included in PFU. The technological design for the first stage, referred to in PFU and the technological design for the second and final stage, referred to in PFU, can be prepared in the form of one document.

The proper performance of the contract by the Contractor is to enable the Employer to permanently, fully, undisturbed, independently and legally use the Installation at the Plant for the purposes of the Plant's operations in a consistent and compatible manner with other devices and installations used for the purposes of the Plant's operations, including without interfering with them at any time proper operation.

A detailed description of the subject of the contract has been presented in the Functional and Utility Program constituting Volume III of the ToR.

3. Detailed rules for the performance of the contract are contained in Volume II of the ToR. Contract template.

4. Information on the requirements referred to in art. 29 paragraph 3a:

4.1. The contracting authority requires employment on the basis of an employment contract by the contractor or subcontractor of all persons carrying out all construction and assembly works that are the subject of this contract / future contract during the performance of the contract.

The above requirement does not apply to persons regarding whom the Contractor demonstrates that the above. the activities will not be performed in any way under the management and at the place and time designated by the Contractor or Subcontractor, and as a rule he does not apply to the Works Manager. This requirement also does not apply to self-employed people and company partners who themselves carry out work related to the subject of this contract.
