The subject of the contract is the delivery of comprehensive delivery (purchase) and provision of gas fuel distribution services - high-methane natural gas with the E symbol to the Employer's facilities and organizational units in accordance with art. 16 of the Public Procurement Law
A detailed description of the subject of the contract, i.e. a list of tapping points together with tariff groups, contracted capacities and planned (estimated) quantities of gaseous fuel consumption is included in Annex 5 to the ToR. The Purchaser reserves the right to increase or decrease the number of gas collection points referred to in Annex 5 to the ToR. The estimated estimated consumption of gaseous fuel during the term of the contract, i.e. from 1.2.2020 to 31.1.2022 (24 months) for all entities is about 11 154 323 kWh, with the proviso that the delivery will start no sooner than after successful completion of the change Seller. The supplied gaseous fuel must meet the requirements and technical parameters in accordance with the provisions of the Energy Law and others.

2. The supplied gaseous fuel must meet the requirements and technical parameters in accordance with the provisions of the Energy Law and executive acts issued on its basis and Polish Standards. The Purchaser is entitled to a discount and a discount in the amount and on the conditions specified in the Distribution System Operator Tariff approved by the President of the Regulatory Office for non-compliance with standards and quality parameters in the gas supplied.
3. The Purchaser is connected to the distribution network belonging to the Distribution System Operator: Polska Spółka Gazownictwa Spółka z oo, Tarnów Branch.
4. The rates of distribution fees must be in accordance with the current tariff of the local DSO and may change during the performance of the contract if the tariff of the local DSO changes. For the purpose of conducting this procedure and comparing offers, the Contractors will calculate the indicated rates for the entire contract period in the calculation of the offer.
5. The Employer informs that the procedure of changing the seller for gaseous fuel outlets will be carried out once again. Agreements with the current supplier for each collection point specified in Annex 5 to the ToR, i.e. Fortum Marketing and Sales Polska SA, ul. Heweliusza 9, 80-890 Gdańsk, POLAND are valid until January 31, 2020.
6. The Awarding Entity allows signing the contract by correspondence.
7. The Purchaser agrees to receive invoices in accordance with the Act of 9.11.2018 on electronic invoicing in public procurement, concessions for construction works or services and public-private partnership.
8. The Contractor is obliged to perform all activities and arrangements with the DSO necessary to carry out the procedure of changing the seller and effectively start selling gas.
9. According to art. 13 section 1 and 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.4.2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, all information can be found in the Terms of Reference section. III point 3.10.
