The subject of the contract is to maintain the cleanliness of roads, pavements, parking lots and squares in the city of Mielec in the years 2023-2024. A detailed description of the subject of the contract is included in Chapters II and III of the Terms of Contract. An integral part of the description of the subject of the contract are the provisions of the model contract, which is presented in Chapter II of the Specification of the Terms of Contract.
1. The subject of the contract is to maintain the cleanliness of roads, sidewalks, parking lots and squares in the city of Mielec in 2022. A detailed description of the subject of the contract is included in Chapters II and III of the Terms of Contract.
2. In accordance with Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (OJ L ...). UE L119 of 4 May 2016, p. 1; hereinafter referred to as "GDPR"), the administrator of personal data is the Municipality – Municipal Office of Mielec (contact: iod@um.mielec.pl, tel. +48 177874033). Personal data will be processed on the basis of Art. 6 para. 1 lit. c GDPR for purposes related to posting. Recipients of personal data. There will be persons or entities to whom the DOK will be made available. post. based on Article 74 of the PPL. Persons data. will be stored, in accordance with Article 78(1) of the Public Procurement Law. Obligation to provide personal data. is a statutory requirement related to participation in the proceedings. With regard to personal data, decisions will not be made by automated means in accordance with Art. 22 GDPR. The data subject has: a) the right to access the data of persons. concerning her, b) the right to rectification of the persons concerned. c) the right to request the administrator to limit the processing of personal data. subject to the duration of the proceedings and the cases referred to in Article 18(2) of the GDPR, d) the right to lodge a complaint with the President of the Office for Personal Data Protection if it considers that the processing of personal data. violates the provisions of the GDPR. The data subject does not have: a) in connection with Article 17(3)(b), (d) or (e) of the GDPR, the right to delete personal data.,b) the right to transfer personal data. (Article 20 of the GDPR), c) the right to object to their processing (Article 6 (1) (c) of the GDPR).
3.The Contracting Authority provides for the use of the so-called. reverse procedure referred to in Article 139(1) of the PPL, i.e. the Contracting Authority will first examine and evaluate the bids, and then make a subjective qualification of the Contractor whose bid was rated the highest in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure. 4.The Contracting Authority shall not provide for an electronic auction. 5.The Contracting Authority does not provide for the submission of a bid in the form of electronic catalogues. 6. The Contracting Authority shall not reserve the right to apply for the award of a contract only by the Contractors referred to in Article 94 of the PPL. 7. The contracting authority does not provide for the submission of variant bids. 8. The contracting authority provides for the award of contracts consisting in the repetition of similar services referred to in Article 214(1)(7) of the PPL, up to the amount of PLN 1,045,456.67 net.9. The contracting authority shall not conduct proceedings to conclude a framework agreement.10. Pursuant to Article 95(1) of the PPL, the Contracting Authority requires the Contractor, subcontractor or further subcontractor to employ on the basis of an employment relationship persons performing works covered by the subject of the contract indicated in the description of the subject of the contract, including physical work, if the performance of these activities consists in performing work within the meaning of the provisions of the Act of 26 June 1974 of the Labour Code. 11. The Contracting Authority allows the performance of the contract with the participation of subcontractors.
12. Communication in post., including submission of tenders, exchange of information and transfer of documents or statements between the contracting authority and contractors, taking into account the exceptions provided for in the Act, takes place using electronic means of communication. Communication between the order and contractors takes place using the public procurement platform - https://przetargi.um.mielec.pl and e-mail - zamowienia@um.mielec.pl. 13. Contractors may jointly apply for the award of a contract - contractors by appointing a representative to represent them in the proceedings or to represent them in the post and conclusion of the contract. The power of attorney must be attached to the offer.
