a) The subject of the contract is a construction work consisting in the reconstruction of streets in the existing road lane in Krakow. The order was divided into 2 parts: Part 1 includes the reconstruction of: Warszewicza Street, Harcerzy Krakowskich Street – from Hallera Street to Niebieskia Street; Popiełuszki Street – from Bieżanowska Street to Korepty Street, Rydygiera Street – from Wielicka Street to Czerniakowskiego Street and Part 2 includes the reconstruction of: Kujawska Street together with Zbrojów Street, Gramatyka Street, Stanisławy Wysocka Street.
b) The Contracting Authority described the subject of the contract: Designed contract provisions, Technical Specification, Indicative Scope of Works, Subject of Works and Detailed Technical Specification.
c) Required warranty period: The minimum warranty period is 36 months. The maximum warranty period is 60 months. Offers with a warranty period of less than 36 months will be rejected
d) Deadline for performance of the contract for both lots: 120 days from the date of conclusion of the contract

b) The Ordering Party described the subject of the order using:
•PPU set No. 2.1 to SWZ;
•Technical Specification of the number 8.1 to SWZ;
•Indicative scope of works in Annex 9.1 to SWZ;
•The object of works set no. 10.1 to SWZ.
•Detailed Technical Specification set 14 to SWZ
(c) The Contracting Authority, in accordance with Article 96 (1) of the Pzp, requires that the Contractor shall have at least 2 self-loading cars min 10 t. addressed to the execution of this contract meeting Euro 6 emissions standards and the other at least Euro 4 emissions standards.
(d) Where the manufacturer's names, trade marks, standards, approvals, technical specifications and reference systems appear in any annex to the CMS, products may be replaced by equivalent names. The Ordering Party shall consider as equivalent solutions such solutions that enable the effect assumed by the Ordering Party to be achieved by means of other technical solutions. An identical solution cannot be considered equivalent solutions, but only those which, in the compared characteristics, indicate exactly the same or very similar utility value. By indicating the manufacturer's names, trademarks, standards, approvals or reference systems, the Ordering Party aimed to determine the minimum quality parameters and functional characteristics that the goods must meet in order to meet the requirements set by the Ordering Party and constitute only a quality standard of the subject of the contract. By the provision concerning the minimum requirements of quality parameters, the Ordering Party understands the requirements of goods contained in publicly available sources, catalogs, manufacturers' websites, and the like. Using exemplary names of the manufacturer is only aimed at clarifying the level of expectations of the Ordering Party in relation to a specific solution.

f) A subcontract for construction works should be in accordance with Annex 2 to the SWZ, i.e. PPU Failure to meet a given condition will result in the Contracting Authority raising objections or objections, respectively.
g) The contracting authority, pursuant to Article 95(1) of the Public Procurement Law, requires the contractor or subcontractor, on the basis of an employment relationship, to employ persons performing the following activities - with the exception of persons performing the so-called independent technical functions in construction within the meaning of the Construction Law:
(a) employees of the lower technical level — organizing and execution of construction works;
(b) manual workers — direct performance of construction works.
The contracting authority allows the possibility of personal performance of the contract by persons conducting business activity or partners of a commercial law company.
h) Deadline for performance of the contract: 120 days from the date of conclusion of the contract.
k) The selected Contractor is obliged to perform the subject of the contract in accordance with the requirements set out in the Act of 11 January 2018 on electromobility and alternative fuels (Journal of Laws of 2021, item 2269, as amended).
