1. The scope of the contract includes: winter maintenance services for roads managed by the President of the City of Kędzierzyn-Koźle and the Kędzierzyn-Koźle County within the city limits of Kędzierzyn-Koźle in the winter season 2023-2024

2. The scope of the contract includes the performance by the Contractor of services:

2.1 Conducting winter maintenance actions on roads /roadways/, given in Annexes A and C to OPZ, in accordance with the principles /standard I/ specified in detail in the SWZ

2.2 Conducting winter intervention maintenance actions on roads / roadways / indicated each time by: District in the field of district roads, specified in Annex C (column no. 5), Kędzierzyn-Koźle Commune in the field of municipal roads, specified in Annex B to the SWZ, according to the rules / standard II / snowmaking specified in detail in the SWZ

2.3 Loading and removal of snow from the roads selected each time.

3. Option according to point II.2.11.

4. The subject of the order also consists of:

4.1. Ensuring readiness for winter road maintenance in accordance with the SWZ

4.2. Providing, purchasing, storing, disposing of and using chemical materials necessary to combat winter slippery conditions and graying of the roadway, zg. from Res. on the types and conditions of application of the means which may be used on public roads, streets and squares

4.3. Civil liability in the scope of business activity and for any damage to third parties resulting from the work carried out by the Contractor.

4.4. Organization of traffic and marking of the place of work during their duration in the event of such a circumstance.

4.5. The Contractor has at its disposal technically efficient tools and devices necessary to perform the contract, in accordance with the SWZ:

4.6. Transfer of equipment from the base to the work site.

4.7. Round-the-clock duty of persons managing the work.

4.8. The Contractor's liability for the consequences of improper conduct of winter road maintenance actions.

4.9. Participation of the Contractor together with the Ordering Party in the inspection of the winter condition of road maintenance, at each request of the Ordering Party.

4.10. Performing all activities necessary to perform the subject of the contract.

4.11. In the event of failure to undertake the obligations incumbent on the Contractor and resulting from the established standard of winter road maintenance, the Contracting Authority, in an emergency mode, shall commission the execution of works to another Contractor, and the costs shall be charged to the Contractor.

4.12. If it is found that the winter road maintenance action has not been undertaken within the prescribed periods, the Ordering Party shall not pay the Contractor for the days on which the action was not carried out, as well as for readiness for winter maintenance.

4.13. The Contractor shall have at his disposal the means of wireless communication enabling connection to a fixed telecommunications network or at least 2 mobile telephones.

4.14. Keeping documentation of "Winter Action".

Conducting winter road maintenance actions The Contractor shall each time agree and notify the Kędzierzyn-Koźle County - Road Infrastructure Department of the Poviat Starosty in Kędzierzyn-Koźle (in the scope of roads managed by the Kędzierzyn-Koźle Poviat) and the Kędzierzyn-Koźle Commune - Road Management Department (in the field of roads managed by the President of the City of Kędzierzyn-Koźle).

The Ordering Parties reserve the right to suspend the commencement and implementation of the winter maintenance action in a given period.

5. Employment requirement for a work contract. Pursuant to Article 95 of the Pzp Act. The Contracting Authority shall require employment by the Contractor or subcontractor on the basis of an employment contract, persons performing the following activities necessary for the execution of the contract:

a) on-call time,

b) snow removal,

(c) deicing.

The method of verification of employment, the authority of the contracting authority in the field of control and the sanctions for non-compliance are set out in the draft provisions of the contract.

6. Detailed description of the subject matter of the contract shall be specified, inter alia: Description of the object of the contract, the Designed provisions of the contract, and the following attachments on the website of the proceeding which are integral part of the SWZ:

Annex A – List of streets in Kędzierzyn-Koźle covered by winter maintenance – standard I (Municipality)

Annex B – List of streets in Kędzierzyn-Koźle covered by winter maintenance – (Municipality),

Appendix C – List of streets in Kędzierzyn-Koźle covered by winter maintenance – standard I and II (District).

7. Term of the contract.

1) Term of the contract: from the date of conclusion to 31.03.2024.

2) Winter season from 15.12.2023. to 15.03.2024r.
