The subject of the contract is the execution of the construction and executive design along with the author's supervision for the task: "Extension of intersections along the national road No. 16 in Lubajny, Stare Jabłonki and Zawady Małe".

1 The Contracting Authority reserves the obligation of the Contractor to perform key tasks personally, i.e.:

1) the activities carried out by the Road Designer, which are the duties of the designer under Article 20 of the Construction Law Act and the provisions of the design specification;

2) the following elements listed in the Table of Design Studies: Table A: No. 4 - Construction Design (road part), No. 5 - Detail Engineering (road part).

With regard to key tasks reserved for personal performance by the Contractor, the Contractor shall not rely on the capacity of the resource sharing entity, under the principles laid down in Article 118 (1) of the Pzp Act, in order to demonstrate the fulfilment of the relevant conditions of participation in the proceedings.

2. The Ordering Party shall require that the contract be completed on time

15 months (counted from the date of conclusion of the Agreement to the date of submission of all studies for acceptance) and with observance of the declared intermediate deadlines for handing over individual studies for acceptance, specified in the Schedule of design works, i.e. among others:

1) up to 15 months from the date of conclusion of the Agreement – submission for receipt of all studies in a single copy, in paper form and in electronic form, with the deadlines for the implementation of individual studies specified in the Schedule of design works,

2) up to 2 months from the date of issue of the decision to authorise the implementation of road investment (ZRID) — submission of descriptions of the state of the property drawn up at the date of issue of the decision of ZRID,

3) up to 2 months from the date on which the decision on the permit for the implementation of the road investment (ZRID) becomes final – stabilization of the boundaries of the road lane in the field.

It is estimated that the term of performance of the Agreement will be 39 months, which consists of:

1) 15 months - for the performance of the obligations specified in § 1 clause 1 point 1 of the Agreement;

2) 5 months – for the administrative procedure ZRiD,

3) 4 months - for the performance of obligations resulting from the tender procedure for selecting the contractor for construction works,

4) 15 months - for the performance of the obligations specified in § 1 clause 1 point 2 of the Agreement during the execution of construction works.
