The tender includes washing and renting arrangements for rough workwear for Kolding Municipality, including classified workwear. The tender shall be conducted as a public tender, cf. the Danish Civil Code. The Public Procurement Act, Act No. 1564 of 15/12/2015 , which means that anyone who is not covered by the exclusion grounds meets any minimum and suitability requirements can submit a tender.

The tender includes a contract for a washing and rental arrangement of rough workwear for Kolding Municipality, including classified workwear. The service will be used by the Contracting Entity's Contracting Department, which is stated in the tender specifications. A 4-year contract, with the possibility of an option of 2x12 months, is offered to enter into force on 1 November 2023.The services must meet the requirements of the requirements specification, the offer list and the Supplier's offer. Exclusion: The contracting entity must exclude a tenderer from participation in the tender if the tenderer is covered by the mandatory exclusion grounds in the Procurement Act §134a, §135 and §136, as well as the voluntary exclusion grounds chosen by the Contracting Entity in the Procurement Act, §137.  Voluntary grounds for exclusion:• The tenderer has breached applicable obligations in the field of environmental, social or labour law, cf. section 137(1)(1) of the Danish Procurement Act. • The tenderer has been declared bankrupt or is undergoing insolvency or liquidation proceedings or the like, cf. section 137(1)(2) of the Danish Procurement Act;• The tenderer has entered into an agreement with a view to distorting competition, cf. section 137 of the Danish Procurement Act, (1) No. 3 • The tenderer has materially breached a previous public contract and the breach has resulted in termination of the contract or similar penalty, cf. section 137(1)(4) of the Danish Procurement Act. • The tenderer has demonstrably and wrongfully attempted to influence the Contracting Entity's decision-making process, has obtained confidential information that may give the Tenderer improper advantages or has grossly negligently provided misleading information, that may have a significant influence on decisions regarding exclusion, assessment of the minimum requirements for suitability, selection or award of a contract, cf. section 137(1)(5) of the Danish Public Procurement Act or • The tenderer has unpaid overdue debts of less than DKK 100,000 to public authorities in respect of taxes, duties or social security contributions under Danish law or the law of the country in which the where the Tenderer is established, cf. section 137(1)(6) of the Danish Procurement Act. Exclusion pba. Regulation other than the Procurement Directive: Exclusion due to tax havens No contract may be awarded to companies established in a country that is included in the EU list of non-cooperative tax jurisdictions and has not acceded to the WTO Government Procurement Agreement or other trade agreements obliging Denmark to open the market for public contracts to tenderers established in that country, cf. section 134a of the Danish Public Procurement Act. Exclusion due to Russian ownership or establishment: No contract may be awarded to the following companies, cf. Council Regulation (EU) 2022/576 of 8 April 2022 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine: *Russian citizens or natural or legal persons, entities or bodies established in Russia *legal persons, entities or bodies of which an entity referred to in point (a) of this paragraph directly or indirectly owns more than 50 %, or *natural or legal persons, entities or bodies acting on behalf of or at the direction of an entity referred to in point (a) or (b) of this paragraph; *Similarly, no subcontractors or supporting entities covered by the above may be used if that actor's contribution is more than 10 % of the contract value;
