1. The scope of works to be carried out by the Contractor shall include, inter alia:

1) marking of the place of works in accordance with the design of the temporary organization of the movement;

2) preparatory works;

3) earthworks;

4) the setting of curbs and concrete edges;

5) execution of the substructure;

6) making pavement pavement;

7) the execution of the exit pavement;

8) making a widening of the roadway;

9) profiling of the slope and bottom of the ditch;

10) setting the vertical marking.

2. This order is included in the “Procedure Plan — Version No 11" of 31.5.2021 published in the Public Procurement Bulletin No 2021/BZP 00002290/11/P under heading No 2.1.43.

3. The detailed scope of works is included in the construction and implementation project, detailed technical specifications for the performance and acceptance of construction works, and in the subject of works which are part of the auxiliary part of the determination of the quantity of works.

1. The object of the works is auxiliary. The Contractor shall be required to carefully check the quantity of works with design documentation before submitting an offer. As the works contract is a lump sum contract, if more works occur in any position in the course of carrying out works, it will not be able to be considered additional works with a demand for additional remuneration.

2. The possible absence in the object of works or in the model cost estimate of certain works necessary to perform on the basis of the design documentation (including in the construction and construction project) does not relieve the Contractor from the obligation to perform them on the basis of the project at the contractual price.

3. The Contractor is obliged to ensure the management of the robots covered by the contract, as long as necessary by persons who are qualified and meet the requirements of the Construction Law. The Contractor's failure to provide personnel to direct the robots gives the right to the Supervisor or Ordering Authority to halt the works in whole or part. Any interruption in the implementation of the works resulting from the lack of personnel to direct the robots will be treated as an interruption arose for reasons on the Contractor's side and cannot provide a basis for changing the time for completion of the works.

4. The Purchaser does not allow the submission of partial offers.

For the selected variant of the execution of the order, its partition is not justified.

A division of the order into parts could introduce several Contractors to the construction site. This situation is unacceptable from the point of view of coordination of work, the interference of the responsibility of the Contractors, the accepted time limit for the execution of works, possible changes to the time limits for the execution of individual elements of works, the failure to coordinate works between the Contractors and the resulting title possible failure to meet execution deadlines.

In addition, the division of the order into parts would increase costs, including the costs of technical facilities, administrative facilities, constituent plazas, materials delivery. The possibility of disputes between the Contractors would adversely affect the entire organization of works and, as a result, the improper execution of the entire Order.

5. The subject of the contract is described as defined in Article 101 (1) (2) and (3), Law Pzp. The Contracting Authority shall allow equivalent solutions to those described provided that the Contractor proves in the tender, in particular by means of evidence referred to in Articles 104 to 107, that the proposed solutions satisfy the requirements set out in the subject description orders.
