The subject of these proceedings is the supply of electricity to facilities (energy consumption points, hereinafter also PPE) listed in Annex 1A - 1H to SWZ - description of the subject of the contract, divided into parts of the contract:

I: supply of electricity for street lighting for 2024 - 3 472 522 kWh,

II: supply of electricity for other facilities for 2024 - 4 474 527 kWh,

III: supply of electricity to Municipal Utilities and Companies for 2024 - 7 174 175

IV: comprehensive supply of electricity for 2024 on a prosumer basis - 96 352 kWh,

V: electricity supply for street lighting for 2025 - 3 472 522 kWh

VI: supply of electricity for other facilities for 2025 - 4 474 527 kWh

1. The subject of these proceedings is the supply of electricity to facilities (energy consumption points, hereinafter also PPE) listed in Annex 1A to the SWZ – description of the subject of the contract: supply of electricity for street lighting for 2024, in the amount of 3 472 522 kWh,

2. The electricity demand referred to in paragraph 1 above is a basic order. In the course of the contract, the ordering party reserves the right to reduce or increase the value of the order to the extent of +/- 15% in relation to the basic amount of electricity for the purchase of energy. The increase in the value of the contract will take place on the basis of the right of option. Detailed information is included in the draft contract Annex 2A to SWZ – Part I of the contract.

3. The detailed scope of the contract is specified in Annex 1A to the SWZ, in accordance with the provisions of the Energy Law Act of 10 April 1997. Other conditions regarding the execution of the contract are set out in the Draft provisions of the electricity sale agreement – Annex 2A to the SWZ.

4. Distribution services will be provided on the basis of a separate agreement concluded by the contracting authority with the relevant Distribution System Operator (referred to as DSO) – DSO data are included in Appendix 1A.

5. The reserve seller is: Enea S.A., PGE Obrót S.A.

6. The requirements (obligations) imposed on the contractor are described in the draft provisions of the sales contract constituting Appendix No. 2A to the SWZ. Performance of activities resulting from the power of attorney constituting Appendix No. 2 to the Agreement for the Sale of Electricity, hereinafter referred to as the Agreement. The contracting authority shall grant the contractor selected in the proceedings a power of attorney.

Existing electricity contracts with existing electricity sellers for PPE included in Annex 1A are concluded for a definite and indefinite period, and the exact description for each of the PPE can be found in the column entitled "Duration of the current contract / notice period" of the above-mentioned annexes.
