Services related to tree felling in ZZ Żywiec

The subject of the contract is the implementation of services related to tree felling in ZZ Żywiec.

Part 1: Intervention services related to the felling of trees posing a safety threat in the area of operation of the Żywiec Catchment Board;

Part 1: Intervention services related to the felling of trees posing a safety threat in the area of operation of the Żywiec Catchment Board;

1. The subject of the contract is a service consisting in intervention (emergency) felling and pruning of trees growing on river slopes, reservoir canopy, near buildings, roads, public utility buildings, agricultural land (posing a safety threat) and removal of scrap, tipping stones, bushes and bushes in the area of operation of the Żywiec Catchment Board in the basic (guaranteed) scope and in the optional scope.

2. The Contractor shall ensure environmental supervision throughout the entire period of contract performance, consisting in monitoring of protected plant and animal species. The rules for environmental supervision have been defined

in the description of the subject of the contract – constituting Annex 2a to the SWZ.

3. The detailed scope and type of works to be performed under the subject of the contract is specified in the documentation of the proceedings, including in particular the description of the subject of the contract constituting Annex 2a to the SWZ, the offer estimate constituting Annex 3a to the SWZ and the draft contract constituting Annex 5a to the SWZ.

Those annexes contain quality requirements relating to at least the main elements constituting the subject of the contract, which fulfils the conditions of Article 246(2) of the PPL.

4. Pursuant to Article 441 of the PPL, the contracting authority provides for the application of the right of option:

4.1 The Purchaser provides for the exercise of the right of option in respect of Lot 1 of the order, consisting in an increase in the maximum contractual remuneration. The maximum value of the option is 100% of the gross remuneration specified in § 5 clause 1 letter a) of the agreement. 4.2 The Ordering Party does not provide for the possibility of submitting a bid covering only the basic (guaranteed) part, without the optional part and vice versa.

Therefore, Part 1 of the contract for which the bid will be submitted includes the Contractor's obligation to perform both the basic part (guaranteed) and the optional part.

4.3. The provision of the service in the scope of the optional part shall take place only at the request of the Ordering Party within the framework and in accordance with the terms of the concluded contract, for the price specified for the optional part in the offer.

4.4 The right of option shall be exercised under the same conditions as the basic order and shall cover the same scope of work.

4.5 The Contractor is not entitled to resign from the exercise of the option and may not submit an offer only in the scope of the basic (guaranteed) contract. The Contractor is obliged to perform the subject of the contract to the full extent, i.e. both the basic contract and the option right.

4.6 The contracting authority shall make the exercise of the right of option conditional on the granting of additional funds for their performance during the contract performance period.

4.7 The purchaser is not obliged to exercise the right of option. The Contractor shall not have the right to claim for failure to exercise the option right.

5 The contractor may submit a tender for one or more lots of the contract.

6. The same Contractor may be awarded a contract for all parts.

7. The Contracting Authority shall not allow the division of the contract within individual lots.

9. The contracting authority does not impose an obligation to carry out an on-site inspection. At the same time, in order to make a proper valuation of the offer, the Contracting Authority recommends that the Contractor carry out a field visit at its own expense – within the time agreed with the Contracting Authority: - Water Supervision in Wadowice – Mrs. Katarzyna Bernaś phone number 532 032 471;

Part 2: Felling of trees in the area of Wadowice Water Supervision;

Part 2: Felling of trees in the area of Wadowice Water Supervision;

1. The subject of the contract is the execution of works related to the felling of trees for pot. Targaniczanka in msc. Andrychów, Andrychów commune, pot. Chochenka in msc. Chocznia, Wadowice commune, pot. Dąbrówka in msc. Gorzeń Dolny, Wadowice commune, Zagórnicki pot., msc. Zagórnik, Andrychów commune, pot. , msc. Inwałd, Andrychów commune - Wadowice county, Małopolskie province, along with the removal of felled wood to the square at the Świnna Poręba Water Reservoir, while the branches will be reproduced and managed by the Contractor.
