The subject of the contract is the purchase and distribution of traction electricity for railway vehicles used by Koleje Śląskie sp. z o.o. The sale of electric traction energy will take place under a comprehensive agreement for the purposes of carrying out transport activities with traction vehicles powered from the 3kV DC traction network.

The comprehensive service will be provided for the purposes of conducting transport activities with electric traction in the following categories of the Ordering Party's trains: fast trains, passenger trains, other trains. Settlement for the electricity consumed for traction purposes will be carried out in accordance with the Bt21 tariff group with the use of measurement indicators installed in the Contracting Authority's traction vehicles. The Contracting Authority provides for the application of the Option Law. Performance of the subject of the contract from 1.01.2024 to 31.12.2025 or until the maximum value of the obligation under the contract is exhausted.

The subject of the contract is the purchase and distribution of traction electricity for railway vehicles used by Koleje Śląskie sp. z o.o. The sale of traction electricity will take place under a comprehensive agreement for the purpose of carrying out transport activities with traction vehicles powered from the 3kV DC traction network. The comprehensive service will be provided for the purposes of conducting electric traction transport activities in the following categories of the Ordering Party's trains:

a.fast trains,

b.passenger trains,

c.Other trains.

The place of supply of electricity is the traction vehicle, and the boundary of the parties in the supply of electricity is at the terminals of the power supplies on the side of the overhead contact line. The Contracting Authority declares that it is a Railway Carrier whose traction vehicles supplied with Traction Energy from the DSO Network are not equipped with meters, however, some of the vehicles have metering and billing indicators to monitor energy consumption and recuperation, and at the same time are settled on the basis of transport performance in the Bt21 tariff group. Billing for the electricity consumed for traction purposes will be carried out in accordance with the Bt21 tariff group with the use of indications measurement indicators installed in the Contracting Authority's traction vehicles.

Due to the fact that during the performance of the contract, the Contracting Authority's traction vehicles will move around the area of the Technical Facilities of Koleje Śląskie (i.e. the area equipped with a traction network powered from a separate one-sided power source, equipped with an electricity metering and billing system), the Contractor will be obliged to reduce the amount of energy consumed indicated by the measuring devices on the traction vehicles by the amount of energy consumed in the settlement period in the area Technical Facilities in the event that the Technical Facilities will be used only by the Contracting Authority's traction vehicles or to reduce the amount of energy consumed indicated by the measuring devices on the traction vehicles by the amount of energy consumed in the settlement period indicated as consumption by the said vehicles in the Technical Facilities in the system used to record data on energy consumption belonging to the Ordering Party.

The provision of the electricity distribution service will be carried out in accordance with the provisions of the Contractor's Electricity Tariff in force for a given settlement period. The Contracting Authority declares that it does not hold a concession for the generation, transmission, distribution or trading of electricity within the meaning of the provisions of the Act of 10 April 1997 – Energy Law (i.e. Journal of Laws of 2021, item 716, as amended). and is a purchaser of electricity within the meaning of the Excise Duty Act of 6 December 2008 (i.e. Journal of Laws of 2020, item 722, późn.zm.). A detailed Description of the Subject of the Contract is presented in the IPU constituting Appendix No. 1 to the Terms of Reference, on the basis of which the Agreement with the Contractor will be concluded.

The Contracting Authority requires the performance of the subject matter of the contract from 1 January 2024 to 31 December 2025 (24 months) or until the maximum value of the obligation under the contract is exhausted. Depending on which of these events occurs first.
