1. The subject of the contract is the implementation of the service of collecting and managing municipal waste from property owners from the Kluczbork Municipality:
a) from all real estate on which residents live,
(b) all immovable property which is partly property on which residents live and in part immovable property on which residents do not live and municipal waste is generated.
A detailed description of the subject of the contract can be found in Annex 1 to the Model Contract and in the Model Contract – Appendix No. 9 to the SWZ.
1. The subject of the contract is the implementation of the service of collecting and managing municipal waste from property owners from the Kluczbork Municipality:
a) from all real estate on which residents live,
(b) all immovable property which is partly property on which residents live and in part immovable property on which residents do not live and municipal waste is generated.

2. Contractors applying for the award of a contract in this procedure must meet the conditions set out in the Regulation of the Minister of the Environment of 11 January 2013 on detailed requirements for the collection of municipal waste from property owners (Journal of Laws of 2013, item 122).
3. The Contracting Authority provides for the award of contracts referred to in Article 214(1)(7) of the Public Procurement Law up to 50% of the contract value. The subject of the above-mentioned orders may be services related to the collection, transport and management of municipal waste from property owners:
a) from all real estate on which residents live,
b) from all real estate, which in part are real estate on which residents live, and in part real estate on which residents do not live, and municipal waste is generated,
in particular as regards:
1) collection and management of municipal waste in a larger amount than provided for in the OPZ,
2) collection and management of other fractions of municipal waste than those provided for in the OPZ,
3) performance by the Contractor of other services or obligations than those provided for in the SWZ, and related to the subject of the contract,
4) implementation of municipal waste collection and management services at a different time than indicated in the Agreement.
The contracts referred to above may be awarded:
1) on terms negotiated with the Contractor similar to the terms of the basic contract, subject to differences resulting from the specificity of the subject of the supplementary contract, including the financial conditions for the performance of a similar contract.
2) once or several times,
3) up to a maximum value of 50% of the value of a given part of the contract.
4. The Purchaser does not allow submission of partial offers.
5. If reference to standards, technical assessments, technical specifications and technical reference systems is indicated in the procurement documents, the Contracting Authority shall allow solutions equivalent to those described.
6. The demonstration of the equivalence of standards, technical assessments, technical specifications and technical reference systems shall be the responsibility of the Contractor and shall be documented and submitted by him together with the tender.
7. To confirm that the services offered comply with the criterion for the evaluation of tenders referred to in Chapter XVII of the SWZ (meeting the exhaust emission standard), the Ordering Party requires the submission of the following means of proof together with the offer:
1) List of equipment to perform the subject of the contract and subject to assessment – Annex 1a to the SWZ,
2) registration certificates or approval certificates or other relevant documents that confirm the exhaust emission standard min. Euro 5.
8. Pursuant to Article 95 of the PPL Act, the Contracting Authority requires the Contractor or Subcontractor to employ persons performing the following activities on the basis of an employment contract:
(a) driving vehicles intended for the collection of waste,
b) handling the loading of waste into vehicles
