The Danish Energy Agency intends to increase the framework agreement on communication services (case no. 2021/S 062-157735) by DKK 35 million to a total of DKK 105 million, corresponding to an increase of 50% of the original value.
The need for the maximum increase is justified by the fact that the estimate of the activity level of the communication effort is adjusted upwards on the basis of the drain from the start of the framework agreement and is due to external unforeseen circumstances.
In determining the original value, the Danish Energy Agency has taken its point of departure in the current situation and taken into account previous experience, as well as included financial support for the need for extraordinary efforts. This recognition has not taken into account a crisis of the proportions seen as a result of war in Ukraine. It is assessed that the Danish Energy Agency has been careful in the planning of the tender, and that the energy crisis due to war etc. could not be foreseen at the time of the tender.
The Danish Energy Agency intends to increase the framework agreement on communication services (case no. 2021/S 062-157735) by DKK 35 million to a total of DKK 105 million, corresponding to a 50% increase in the origin, due to external unforeseen circumstances, as a result of the energy crisis and war in Ukraine. This has led to a significantly greater need for communication efforts aimed at reducing and using energy efficiently.
According to section 183 of the Danish Public Procurement Act, a contract may be amended if the amendment is not considered to be a change of
basic elements, if;
(1) the need for the amendment could not have been foreseen by a diligent contracting entity.
(2) the overall nature of the contract does not change;
(3) the value of the modification does not exceed 50% of the value of the original contract.

No changes are made to the other aspects of the framework agreement other than the increase, so that the requirements for the overall nature of the framework agreement are not changed and the increase is not more than 50 % of the original value is complied with.
