The Contractor is obliged to perform the subject of the contract on the terms and conditions contained in the Terms of Contract Specification (SWZ), Table No. 1 (Annex No. 2 to the SWZ), Table No. 2 (Annex No. 2A to the SWZ) and the guidelines of the draft contract (Annex No. 3 to the SWZ). Maintaining cleanliness consists in performing a service in the facility, taking into account the above-mentioned cleaning zones, and above all compliance with health and safety and fire protection procedures. and the above-mentioned procedures applicable to the Ordering Party.

1 Examination rooms and treatment rooms

The Contractor is obliged to perform the subject of the contract on the terms and conditions contained in the Terms of Contract Specification (SWZ), Table No. 1 (Annex No. 2 to the SWZ), Table No. 2 (Annex No. 2A to the SWZ) and the guidelines of the draft contract (Annex No. 3 to the SWZ). Maintaining cleanliness consists in performing a service in the facility, taking into account the above-mentioned cleaning zones, and above all compliance with health and safety and fire protection procedures. and the above-mentioned procedures applicable to the Ordering Party. The Ordering Party reserves the right to change the size of the area provided for the cleaning service, depending on the current demand and actual state, also with the areas of sanitary and hygienic zones, without legal consequences for the Ordering Party.

The Ordering Party reserves the right to microbiological control of the services provided in the Day Departments once a year, and in addition, the Ordering Party has the right to additional inspections in the event of a change in the epidemiological situation (e.g. the occurrence of an epidemic outbreak). Cultures can be taken not only from flat horizontal or vertical surfaces, but also from objects and materials that are subject to washing and disinfection (washbasins, washbasin faucets, bathroom taps, etc.). In the event of incorrect results, the costs of the tests will be charged to the Contractor, which does not exclude the Contractor's liability in the scope of contractual penalties, administrative penalties or other compensation claims imposed on him in this respect.

The Ordering Party reserves the right to inspect the cleanliness of materials and devices used to maintain cleanliness, in particular washing sets, consumables (cloths, mops, etc.).

Detailed cleaning schedules - days, hours will be agreed directly with the Contractor with whom the contract will be signed. The Contractor is obliged to submit the agreed schedules to the Contracting Authority at the latest on the day of signing the contract. The frequency of cleaning of a given element results from Table No. 1, constituting Annex 2 to the SWZ and Table No. 2, constituting Annex 2A to the SWZ.

For the purposes of performing the subject of the contract, the Contracting Authority requires, in accordance with Article 29(3a) of the Public Procurement Law, that a minimum of two employees be employed under an employment contract within the meaning of the provisions of the Act of 26 June 1974 - Labour Code (i.e. Journal of Laws of 2020, item 1320, as amended).
