The subject of the contract is the execution by the Contractor for the Employer (including design, delivery, assembly, commissioning, configuration and commissioning) of the investment entitled: "Installation of a new flue gas discharge installation from PTWM boilers No. 8 and 9 of the Siekierki CHP Plant in Warsaw".

The subject of the contract is the execution by the Contractor for the Employer (including design, delivery, assembly, commissioning, configuration and commissioning) of the investment entitled: "Construction of a new flue gas discharge installation from PTWM boilers No. 8 and 9 of the Siekierki CHP Plant in Warsaw".
2. The scope of the contract includes, m.in design, delivery, assembly, commissioning, configuration and commissioning of a new flue gas outlet, which includes, among others:
- a new chimney with the necessary installations,
- new flue gas ducts with necessary cut-offs,
- two new exhaust gas fans,
- new and modernized power supply and control installations for the new flue gas installation,
- new and upgraded emission monitoring installations (CEMS),
- buildings, installations and existing infrastructure necessary for the development of the Installation,
- all devices, installations and other elements necessary for the proper functioning and safe operation of the Installation.
3. The subject of the contract shall be executed by the Contractor according to the "turnkey" formula in accordance with:
- Draft provisions of the 23DOZZ119 agreement and attachments (in particular with the technical concept developed by PROEN GLIWICE sp. z o.o. with its registered office in Gliwice, i.e. Technical Concept No. 04/ECS/2021 regarding the construction of a new steel chimney for PTWM-100 boilers No. 8 and 9, excluding the demolition of the existing chimney and flue constituting Annex 1 to the Draft provisions of the 23DOZZ119 agreement, as well as industry annexes describing the boundaries and requirements, which are also annexes to this Draft provisions of the 23DOZZ119 agreement,
- documentation developed by the Contractor and agreed with the Contracting Authority.
4. The "turnkey" formula means comprehensive performance by the Contractor of all works in all industries in order to implement the subject of the Agreement and ensure its functioning in accordance with the conditions resulting from the Agreement, including: m.in. execution of such works as: development of complete technical documentation (including, m.in. inventory, measurements and tests, construction design, executive and as-built designs and other documentation in all industries), conducting appropriate arrangements, official proceedings and performing all activities for the purpose of obtaining appropriate opinions, decisions, official and formal permits (except for changing or obtaining a new decision on environmental conditions, which is within the scope of the Ordering Party's obligations), preparation of the area and construction facilities, fencing of the workplace, complete dismantling and assembly as well as temporary and other installations, delivery of all materials, apparatus, fittings and devices necessary to perform the work, execution of the necessary spacers and demolitions, execution of all transport works, implementation of complete construction, assembly, installation, object and programming works (including on the side of the digital system), utilization of waste resulting from the work, regulation and commissioning of facilities included in the Installation, organization and participation m.in. in the trial operation of the Installation and transferring it to operation, execution of all necessary accompanying and finishing works, both those included and not included in the tender materials and the submitted offer, provision of services resulting from guarantee obligations and performance of all other necessary works ensuring the completeness of the performance of the subject of the Agreement, in accordance with its "turnkey" formula.
