1. The subject of the contract is a comprehensive supply of high-methane natural gas (group E), i.e. the supply of gaseous fuel together with the distribution service to the Ordering Party's gas consumption points (PPG) divided into two parts of the contract:
1.1. Part I of the order concerns PPG settled according to mixed prices (tariff prices and competitive market), indicated in Annex 1A to the SWZ, in the period from 01.01.2024 to 31.12.2024, with a fuel demand of 21 732 678 kWh – basic order,
1.2. Part II of the order concerns PPG settled according to competitive market prices, indicated in Annex 1B to the SWZ, in the period from 01.01.2024 to 31.12.2024, with a fuel demand of 3 048 211 kWh – basic order,
applies to PPGs billed at mixed prices (tariff prices and competitive market prices)1. The subject of the contract is a comprehensive supply of high-methane natural gas (group E), i.e. the supply of gaseous fuel together with the distribution service to the Ordering Party's gas consumption points (PPG) settled at mixed prices (tariff prices and competitive market), indicated in Annex 1A to the SWZ, in the period from 01.01.2024 to 31.12.2024, with a fuel demand of 21 732 678 kWh – basic order,
2. Gaseous fuel should be delivered around the clock to delivery and receiving points listed in Annex 1A to the SWZ, which is a set of gas equipment used to connect the internal network, owned by the Ordering Party with the gas network of the system operator.
3. In the course of the contract, the Ordering Party reserves the right to reduce or increase the amount of gaseous fuel in the range of up to +/- 10% of the basic order. The increase in the amount of gaseous fuel will occur on an option basis. The rules, scope and manner of using the above by the Ordering Party are described in Appendix 2A to the SWZ – Draft provisions of the contract in § 1 clauses 3 and 4.
4. If the Ordering Party is/are an entity entitled to settlements according to tariff prices approved by the President of ERO within the meaning of the Act of 26 January 2022 on special solutions for the protection of gaseous fuel consumers in connection with the situation on the gas market, the following proceedings have been accompanied by STATEMENTS OF THE RECIPIENT OF GASEOUS FUELS signed by the Contracting Authority on the purpose of the gaseous fuel, according to the template attached to the Regulation of the Minister of Climate and Environment of 28 January 2022. A given PPG may be partially or fully settled according to the prices from the Sales Tariff approved by the President of ERO – information is included in Annex 1A to the SWZ – description of the subject of the contract.
5. Information on the subject of the contract and the obligations of the Contracting Authority and the Contractor are included in Appendix 2A to the SWZ – Draft provisions of the contract.
6. Information on the currently applicable agreements is described in Annex 1A to the SWZ in the column "Duration of the current contract / notice period".
