Delivery and assembly together with the design and commissioning of 17 solar collector installations, 6 biomass boiler installations as part of the Project entitled "Air Protection in the Żychlin Commune"

The subject of the order is the delivery and assembly together with the design and commissioning of 17 solar collector installations and 6 biomass boiler installations as part of the Project entitled "Air Protection in the Municipality of Żychlin Through the Use of Renewable Energy Sources on Residential and Public Buildings"

The subject of the contract is the supply and assembly together with the design and commissioning of 17 solar collector installations and 6 biomass boilers installations: preparation of design documentation for the installation of solar collectors and biomass boilers installations (pellets) in private residential buildings belonging to the inhabitants of the Żychlin commune, supply of equipment and installation elements, carrying out on-site assembly of the installation based on the completed project documentation, including commissioning and instruction. Four sets of installations are envisaged, in quantities:

• Set I: 2 flat solar collectors, supplying a capacitive heater with a capacity of min. 240 dm3 in quantity of 11 items

• Set II: 3 flat solar collectors, supplying a capacitive heater with a capacity of min. 270 dm3 in an amount of 6 pcs

• Set III: biomass boiler (pellet) with a minimum heat output of 15 kW with a fuel container with a capacity of min. 250 dm3 in quantity of 3 pcs

• Set IV: biomass boiler (pellets) with a minimum heat output of 20 kW with a fuel container with a capacity of min. 300 dm3 in quantity of 3 pcs

A detailed description of the subject of the contract as well as a description of how to perform the task is in Part III ToR entitled: Functional and Utility Program (PFU). NOTE: The Employer informs that PFU also includes a description of the subject of the contract for delivery and assembly, together with the design and commissioning of 60 photovoltaic micro-installations on residents' private real estate and 10 photovoltaic micro-installations on public buildings that are not covered by this tender procedure.

6. Grounds for excluding the Contractor from the procedure, including the grounds referred to in art. 24 paragraph 5 of the Public Procurement Law 6.1. The Employer will exclude the Contractor from the proceedings if the conditions specified in art. 24 para. 1 items 12 - 23 of the Act 6.2. In addition, the Employer will exclude the Contractor from the procedure pursuant to art. 24 (5) point 1), 2), 4) or 8) of the PZP Act, i.e. the Contractor: 6.2.1. In relation to which liquidation has been opened, the arrangement approved by the court in the restructuring proceedings provides for satisfaction of creditors by liquidation of its assets or the court ordered the liquidation of his property pursuant to art. 332 paragraph 1 of the Act of 15 May 2015 - Restructuring Law (i.e. Journal of Laws 2019 item 243) or whose bankruptcy was announced, with the exception of the contractor who, following the declaration of bankruptcy, entered into an arrangement approved by a final court decision, if the arrangement does not provide for satisfaction of creditors by liquidation of the assets of the bankrupt, unless the court ordered the liquidation of his assets under art. 366 section 1 of the Act of February 28, 2003 - Bankruptcy Law (i.e. Journal of Laws of 2019, item 498); 6.2.2. Who has seriously violated professional obligations, which undermines his integrity, in particular if the contractor as a result of intentional action or gross negligence he did not perform or improperly performed the contract, which the contracting authority is able to demonstrate by appropriate means of evidence; 6.2.3.which, for reasons attributable to him, failed to perform or improperly significantly performed a previous public procurement contract or concession agreement concluded with the awarding entity, referred to in art. 3 clause 1 points 1-4, which led to the termination of the contract or the award of damages; 6.2.4. Which violated the obligations regarding the payment of taxes, fees or social security or health insurance contributions, which the contracting authority is able to demonstrate by means of appropriate evidence, except in the case of referred to in paragraph 1 point 15, unless the contractor has made payments of taxes, fees or social security or health insurance due together with interest or fines or has entered into a binding agreement on the repayment of these debts. 6.3 The contractor shall be excluded in accordance with art. 24 paragraph 7 of the PZP Act.
