1.The subject of the contract is a comprehensive supply of gaseous fuel in the form of high-methane natural gas type E. The subject of the contract includes the sale and distribution service for 69 facilities of the Ordering Party, indicated in Annex 1 to the Description of the subject of the contract.
2. During the term of the contract, the Contractor shall supply gaseous fuel to the consumption points covered by the contract in an amount corresponding to the actual demand of the Contracting Entity, regardless of the estimated forecast of its consumption.

1. The subject of the contract is a comprehensive supply of gaseous fuel in the form of high-methane natural gas type E. The subject of the contract includes the sale and distribution service for 69 facilities of the Ordering Party, indicated in Annex 1 to the Description of the subject of the contract.
2. During the term of the contract, the Contractor shall supply gaseous fuel to the consumption points covered by the contract in an amount corresponding to the actual demand of the Contracting Entity, regardless of the estimated forecast of its consumption.
3. Due to the nature of the procurement, it is not possible to determine the exact consumption of the gaseous fuel covered by the subject-matter of the contract. For this reason, the Ordering Party presented a foreseeable amount of gas fuel consumption (Annex No. 1 to the Description of the Subject of the Contract). The quantitative range is the estimated range determined by the Ordering Party with due diligence. The contracting authority, despite exercising due diligence, anticipates that the actual amount of gas consumption may change, i.e. increase or decrease while maintaining the offered unit prices. The guaranteed minimum amount of call shall be 70 % of the estimated demand.
4. Detailed characteristics of the subject of the contract are attached as Annex 1 to the SWZ – Description of the subject of the contract and Appendix No. 1 to the Description of the subject of the contract.
5. The Contractor shall act as a Commercial Operator and the Entity Responsible for Commercial Balancing for fuel sold to the facilities of the Contracting Entity.
6. The Contractor, based on the power of attorney granted, will be obliged to:
1) notification to the Distribution System Operator for the implementation of the natural gas sales contract concluded with the Contractor;
2) carry out the procedure of changing the natural gas supplier;
3) representing the Ordering Party in contacts with the existing Natural Gas Seller or Distribution System Operator in matters related to the process of changing the supplier.
