The subject of the contract is the supply of electricity according to the provisions of the Law of 10 April 1997 Energy Law (i.e. Journal of Laws of 2021 item 716 with amended) for the needs of the Komunalna Komunalna Company Sp. z o.o. in Słupsk. The estimated (forecast) electricity consumption [MWh] between 01.07/2022 and 30.06/2023 is 2,030 MWh together with trade balancing. The projected energy consumption specified by the Ordering Authority is only indicative and does not constitute an obligation on the part of the Contracting Authority to purchase energy in the quantity given and is not at the same time a limit quantity of its purchase. A possible change in the estimated consumption will not result in additional costs for the Ordering Party, other than the settlement for the amount of energy actually consumed according to the price specified in the contract. This order does not cover electricity distribution services.

c.d. (OPZ) Distribution services are provided on the basis of separate contracts concluded by the Contracting Authority with the Distribution System Operator (OSD), which is Energa Operator S.A. The scope of the subject matter of the contract covered by this proceeding specifies the description of the subject matter orders (Annex 1 to SWZ), containing the locations and description of the electricity intake points and the model contract (Annex 9 to the SWZ) together with the list of electricity consumption points covered by the contract and the model of power of attorney, forming an integral part of this SWZ. The subject of the contract also includes the purchase of electricity generated by the Ordering Party and entered into the OSD electricity grid together with trade balancing at an estimated (forecast) amount of 4 MWh.
