Designation of a multidisciplinary team composed of:

— an architect,

— a stability engineer,

— an engineer in special techniques,

— a counsellor at EPB,

— a health safety coordinator,

— a circular economy adviser, and

— a PMR Accessibility Advisor.

For this project author's assignment, the contracting authority wishes to designate a multidisciplinary team composed of an architect, a stability engineer, a special techniques engineer, an ILL adviser, a health safety coordinator, a resource management adviser and an adviser PMR accessibility.

The contracting authority wishes to have a direct contractual relationship with the architect.

In the event that the specific personnel necessary to carry out all of the planned assignments do not meet within the same professional structure, a team of participants is formed into a group of economic operators.

The person who will represent the group with regard to the contracting authority, and who will be responsible for coordinating the studies and services carried out by the other members of the group is the architect.

Applications which do not guarantee the contracting authority from the selection phase to benefit from this direct contractual link will be rejected.

However, subcontracting is permitted for the following missions:

— a stability engineer,

— an engineer in special techniques,

— an EPB adviser,

— a health safety coordinator,

— a resource management advisor, and

— an Accessibility Advisor.

The contracting authority shall draw the attention of economic operators participating in this contract in the form of a grouping which, at the stage of submission of applications for participation, it allows the stability engineer, the special engineering engineer, the landscape architect, the energy performance advisor, the acoustic engineer and the Safety and Health Coordinator (hereinafter 'the design offices concerned ') to be subcontractors to several candidate groupings, provided however that there is no interference with competition or agreements. Applicants should therefore be careful not to provide information to their subcontractors that would go beyond the strict scope of their mission.

The attention of economic operators submitting several applications (i) in isolation and in grouping with other economic operators, or (ii) within differently composed groups) and the groupings in which they participate is drawn to the prohibition of multiple participations at the stage of submission of tenders by Article 54, paragraph 2, of the Royal Decree of 18.4.2017. The consequence of this prohibition is that tenders submitted by tenderers concerned by a multiple participation must all be rejected.

If the two candidates concerned by the multiple participation of an economic operator are selected, the latter may only submit an offer in the context of one of the two candidates. Applicants concerned must anticipate this situation to avoid rejection of their offer.

In case of multiple participation of one or more economic operators, the selection procedure will take place as follows:

1) firstly, the contracting authority will analyze and provisionally classify the candidates concerned, taking into account any duplication;

2) in a second step, he will inform the groups concerned by a risk of double offer of their provisional classification and will invite operators present in several groups to choose the one by which the offer is introduced;

3) thirdly, he will proceed to the final classification of the candidacies after the withdrawal of one or more groups concerned by the risk of a double offer and will invite the various candidates to formulate an offer.
