Description:
Collection and management of municipal waste from real estate where residents live in the commune of Tuszyn in the period from 1.1.2020 to 31.12.2020.

The subject of the contract is the provision of a service consisting in the collection and management of municipal waste from real estate where residents live in the commune of Tuszyn, area Eastern Łódź, province Łódź, in a manner ensuring achievement of appropriate levels of recycling, preparation for re-use and recovery by other methods and reduction of the mass of biodegradable municipal waste sent to landfill, in accordance with the provisions of the Act of 13.9.1996 on maintaining cleanliness and order in communes (Journal of Laws U. of 2018, item 1454, as amended) and executive acts, as well as the provisions of the waste management plan valid for the Łódź Voivodeship and local law provisions in force during the performance of the contract, in particular: specifying the detailed manner and scope of providing services in the field of receiving municipal waste from property owners and managing this waste.

The subject of the contract includes the provision of a service consisting in the collection, transport and management of municipal waste arising on residential real estate on which municipal waste is generated, in the commune of Tuszyn, in accordance with applicable regulations in this respect. The subject of the contract includes the collection of waste from single-family and multi-family residential real estate, from a Selective Waste Collection Point and from pharmacy outlets.

2. The subject of the contract is the provision of a service consisting in the collection and management of municipal waste from real estate where residents live in the commune of Tuszyn, area Eastern Łódź, province Łódź, in a manner ensuring achievement of appropriate levels of recycling, preparation for re-use and recovery by other methods and reduction of the mass of biodegradable municipal waste sent to landfill, in accordance with the provisions of the Act of 13.9.1996 on maintaining cleanliness and order in communes (Journal of Laws U. of 2018, item 1454, as amended) and executive acts, as well as the provisions of the waste management plan valid for the Łódź Voivodeship and local law provisions in force during the performance of the contract, in particular: specifying the detailed manner and scope of providing services in the field of receiving municipal waste from property owners and managing this waste, by keeping the rules of maintaining cleanliness and order in the commune of Tuszyn.

The subject of the contract includes the provision of a service consisting in the collection, transport and management of municipal waste arising on residential real estate on which municipal waste is generated, in the commune of Tuszyn, in accordance with applicable regulations in this respect. The subject of the contract includes the collection of waste from single-family and multi-family residential real estate, from a Selective Waste Collection Point and from pharmacy outlets.

3. As part of the contract, the Contractor is obliged in particular to:

1) collect municipal waste directly from real estate collected by real estate owners, including:

A. any quantity of unsorted (mixed) municipal waste left after segregation, collected in adapted containers or bags;

B. segregated waste collected in bags or containers in the fractions, quantities and dates specified in Annex 1 to this ToR "Detailed description of the subject of the contract":

- in blue with the inscription 'Paper' - intended for paper, including cardboard, paper packaging waste and cardboard packaging waste,

- in yellow with the inscription "Metals and plastics" - intended for metals and plastics, including metal packaging waste, plastic waste, including plastic packaging waste, and multi-material packaging waste,

- in green with the inscription "Glass" - intended for glass including packaging waste made of glass (without division into colored and white),

- brown with the inscription "Bio" - intended for bio-waste,

- in gray or black with the inscription "Ash" - intended for ash. Ash can also be collected on real estate in dedicated containers owned by the property owner; above. bags must have inscriptions indicating the purpose of the bag;

C. construction and renovation waste in the form of waste ceramic materials, small brick and concrete debris from repairs resulting from minor construction or renovation works not requiring a building permit or notification of the intention to carry out works to the competent authority;

D. bulky waste and electro-waste as well as used tires in the form of collection organized twice a year (the first date in the spring, the second date in the autumn). Used tires, bulky waste and electro-waste will be collected directly from the resident's property;

2) provide, without additional payment, bags for sorted waste, which should be handed over to the owner of the property when collecting sorted waste. The contractor will leave new empty bags at the entrance to the property each time in the amount corresponding to the number and fraction of waste collected;

3) provide additional bags for owners who accumulate a greater amount of segregated waste or for various reasons will not have a bag for the appropriate fraction of waste, as well as for residents who submit new properties to the system. Access to such bags will be provided by the Contractor at the headquarters of the City Hall in Tuszyn, at the Selective Waste Collection Point, at the Municipal Culture Center. On. St. Reymonta in Tuszyn, in the branch of the Municipal Culture Center in Tuszyn Las, in the Housing Economy Plant in Tuszyn. In addition, depending on the statement made in the offer, the Contractor shall provide access to the sacks at the village leaders in the Tuszyn commune in all villages and at the chairmen of the District Councils: Tuszyn Stare Miasto, Tuszyn Szpital, Tuszyn Las or not;

4) collect from the PSZOK Selective Municipal Waste Collection Point, located in the commune of Tuszyn, any amount of waste delivered by residents, broken down into the following fractions set out in Annex No. 1 to this ToR, the "detailed description of the subject of the contract", provided that in PSZOK it limits the amount of used tires collected, bulky waste as well as construction and demolition waste collected from property owners during the year. Collection of waste from PSZOK should take place within 3 working days from the time of notification of such need by the Employer or the operator of ongoing PSZOK service, by e-mail, fax or telephone. The entity providing ongoing PSZOK service on behalf of the Employer is Miejskie Przedsiębiorstwo Gospodarki Komunalnej in Tuszynek Majoracki, ul. Starościańska 6 lok. 4, POLAND. The contractor is obliged to equip PSZOKU with appropriate containers for the selective collection of the above-mentioned waste within 3 working days from the date of notification of such need by the Employer by e-mail, fax or telephone. The Employer will allow collection of waste on the agreed date. Records of waste collected from PSZOKU will be kept by the Contractor;

5) The Contractor shall equip in sealed containers pharmacy points indicated by the Employer, located in the commune of Tuszyn, used to collect expired drugs, damaged thermometers, in the "detailed description of the subject of the order" quantities and dates specified in Annex No. 1 to this ToR. Collection of waste from the above points should be made within 3 business days from the date of such need being reported by the Employer by e-mail, fax or telephone;

6) collect selectively collected waste (expired drugs and batteries) from containers located at the headquarters of the City Hall in Tuszyn for the residents of the municipality of Tuszyn. The collection should take place within 3 working days from the moment of notifying such need by the Employer by e-mail, fax or telephone;

7) managing all collected waste from the Selective Waste Collection Point, pharmacy outlets referred to in Part IV para. 2 of Annex 1 to the ToR and from property owners in accordance with the applicable law. Collected municipal waste collected from residents of residential real estate located in the commune of Tuszyn directly or through a transhipment station referred to in art. 23 clause 10 of the Act of 14.12.2012 on waste, hand it over to municipal installations that have been put into use and have the required decisions allowing for the processing of waste referred to in art. 35 section 6 item 1 subject to art. 158 section 4. Waste Act. In accordance with art. 35 section 6 pt. 1 municipal installation for the processing of unsorted (mixed) municipal waste or residues from the processing of this waste must be specified on the list referred to in art. 38b paragraph 1 point 1 meeting the requirements of the best available technique referred to in art. 207 of the Act of 27.4.2001 - Environmental Protection Law or technology referred to in art. 143 of this Act. The Contractor, taking into account the hierarchy of waste management methods, will hand over the waste to the nearest places where it can be processed. The contractor will indicate the name of the installation in the offer.

Bio-waste collected from residents of residential real estate located in the commune of Tuszyn should be sent directly or through another waste collector to installations ensuring the processing of bio-waste, which meets the requirements set out in legal provisions, which have been put into use and have the required decisions enabling the processing of waste. Contractor taking into account the hierarchy of waste management methods and the best available technique referred to in art. 207 of the Act of 27.4.2001 - Environmental Protection Law, or technology referred to in art. 143 of this Act, will transfer the waste to the nearest places where it can be processed.

Selectively collected municipal waste should be sent directly or through another waste collector to the waste recovery or disposal facility, in accordance with the waste hierarchy as referred to in art. 17 of the Act of 14.12.2012 on waste (Journal of Laws of 2019, item 701, as amended) and in accordance with applicable regulations. The Contractor is responsible for the proper management of waste in accordance with currently applicable provisions of law;

8) The Contractor is obliged to manage the collected municipal waste in a manner ensuring achievement of the required levels of recycling, preparation for re-use and recovery by other methods and limiting the mass of biodegradable municipal waste sent to landfill, in accordance with the provisions of the Act of 13.9.1996 on maintaining cleanliness and order in communes (Journal of Laws of 2018, item 1454, as amended) and implementing provisions to this Act;

9) keeping and providing the Employer with documentation related to the subject of the contract:

a) waste transfer cards (in accordance with the applicable model) to installations included in the list of existing municipal installations for municipal waste processing, referred to in art. 38b paragraph 1 of the Act of 14.12.2012 on waste and having the required permits allowing for the processing of waste, waste transfer cards (in accordance with the applicable model) to installations ensuring the processing of bio-waste meeting the requirements set out in legal regulations and waste transfer cards sorted to installations having the relevant permits for recovery or disposal of waste, in accordance with applicable regulations. The waste transfer cards should be accompanied by printouts from the weighing scale weighing waste when accepting waste at the waste treatment installation. Waste transfer cards must clearly state that the waste comes from the commune of Tuszyn;

b) records of waste transferred in accordance with applicable law;

c) reports referred to in art. 9n of the Act on maintaining cleanliness and order in municipalities;

d) a summary of the amount of all waste received from residential real estate, including the address of the real estate, broken down by individual fraction by volume. Statements should include monthly periods and should be provided after the end of each month of service provision within 14 days;

e) a summary of the amount of individual types of waste collected from PSZOK by weight, and a transfer card for waste collected from PSZOK;

f) protocols confirming the monitoring of the obligation on the real estate owner to collect municipal waste separately (minimum 20 real estate inspections per month);

g) reports and printouts of the measuring balance from specialist vehicles weighing, referred to in part VII, sec. 11 point 2 of Annex 1 to the ToR;

h) providing necessary information enabling the Employer to draw up an annual report in accordance with art. 9n of the Act on maintaining cleanliness and order in municipalities;

i) provide other necessary documents within 7 days, at the request of the Employer;

10) conducting controls of separately collected municipal waste by households (part VIII of the Annex to the ToR);

11) conducting an action promoting selective waste collection, consisting in the development, printing and delivery to the City Hall in Tuszyn, a Selective Waste Collection Point, the Municipal Culture Center On. St. Reymonta in Tuszyn, branch of the Municipal Cultural Center in Tuszyn Las, Zakład Gospodarki Mieszkaniowej in Tuszyn, village leaders in the commune of Tuszyn in all villages and to the chairmen of the district councils: Tuszyn Stare Miasto, Tuszyn Szpital, Tuszyn Las in the commune of Tuszyn, information and educational materials ( leaflets, brochures) during the term of the contract until June 30, 2020. The leaflet will be issued in the quantity of 5,000, in A5 format, and will contain text and graphics printed in color. The content of the leaflet or brochure will contain at least information on the principles of proper waste segregation. Before carrying out the action, the Contractor shall submit to the Employer a draft leaflet for approval. The Contractor shall inform the Ordering Party about the completion of the campaign promoting selective waste collection and will inform about the amount of leaflets issued;

12) carrying out information and educational activities among the inhabitants of the commune of Tuszyn regarding the proper management of municipal waste, in particular in the field of selective collection of municipal waste, in a manner agreed with the Employer, by 30.6.2020;

13) The Contractor undertakes to possess the technical capabilities necessary for the correct and reliable performance of the contract;

14) weighing vehicles referred to in part VII, paragraph 11 point 2 of the Annex to the ToR must be made on scales that have been legalized and meet the requirements set out in the Act on measures (Journal of Laws of 2019, item 541, as amended) and on the property where the Contractor has a legal title or based on a concluded contract;

15) waste collection will take place on the basis of an approved waste collection schedule. It is the Contractor's responsibility to develop a waste collection schedule, agree it with the Purchaser, print leaflets with this schedule and deliver them to all property owners residing in the commune of Tuszyn. The Contractor shall draw up a schedule for the entire duration of the contract concluded under this contract;

16) waste collection will take place from the properties included in the list, which will be forwarded by the Employer and updated in accordance with the provisions of Annex 1 to the ToR;

17) The Contractor bears full responsibility for the proper management of the collected waste in accordance with the provisions in force in this respect. This applies to, among others possible transhipment of waste, its transport, formal and legal matters related to the collection and delivery of waste to an authorized entrepreneur conducting activities in the field of waste processing;

18) The Contractor shall be fully liable for all damages caused to the Employer and third parties during the performance of the contract, including damages to waste collection containers resulting from the service provided by him.
