as part of the task "Thermo-modernization of residential buildings in the Municipality of Zawiercie – Niedziałkowskiego 2, Niedziałkowskiego 23, Niedziałkowskiego 24, Niedziałkowskiego 25", POIS.01.07.01-00-0045/20 under the POIS.01.07.01 sub-measure Supporting energy efficiency in residential buildings in the Silesian Voivodeship, POIS.01.07.00 activities – comprehensive elimination of low emissions in the Silesian Voivodeship priority axis POIS.01.00.00 – emission reduction economy of the Operational Programme Infrastructure and Environment 2014-2020.

1. The subject of the contract is: Task No. 1: Thermomodernization of the building at 23 Niedziałkowskiego Street.

The scope of works includes:

- necessary dismantling work,

- damp insulation of vertical foundation walls,

- injection of foundation walls,

- insulation of the ceiling,

- reinforcement of the roof truss

- reinforcement of the ceiling above the first floor,

- replacement of window joinery and external door joinery,

- replacement of window sills, flashings, replacement of gutters, drain pipes,

- renovation of chimneys,

- execution of chimney enclosures,

- dismantling and re-assembly of information boards, flag holders, lighting fixtures, antennas, located on facades, arranging the wiring,

- restoration of sidewalks/bands around buildings,

- insulation of external walls from the inside,

- insulation of the inner walls of the attic,

- façade of annexes,

- insulation of the ceiling,

- replacement of roof covering,

- reinforcement of the ceiling under the first floor,

- execution of an internal gas installation,

- execution of electrical and lightning protection installation in accordance with the project,

- installation of protective earths and equalization connections.

- installation of CO, DHW.

2. The Description of the Subject of the Order (OPZ) constitutes Appendix No. 1A to the SWZ.

3. The detailed scope of works is specified in the design documentation, technical specifications for the execution and acceptance of construction works and bills of quantities (as an auxiliary element to the price calculation) and technical expertise, which constitute annexes to the tender specifications (hereinafter referred to as the GSM).

4. The Contractor is obliged to provide a guarantee for the subject of the contract for not less than 3 years from the date of final acceptance of the works.

5. The warranty period for the subject of the contract is 5 years.

6. The tender drawn up must be in accordance with the subject of the contract, the design documentation and the technical specifications for the execution and acceptance of the works.

7. Obligation to employ under a contract of employment.

The contracting authority, acting pursuant to Article 95(1) of the Public Procurement Law, requires that as part of the performance of the contract, activities directly related to the subject of the contract (included in the so-called direct costs resulting from the bill of quantities, i.e.: construction, construction, installation, electrical, finishing works) should be performed by persons employed under an employment contract within the meaning of Article 22 § 1 of the Act of 26.06.1974 Labour Code (i.e. Journal of Laws of 2022.

item 1510 with later dates. as amended), regardless of whether these works will be performed by the Contractor, subcontractor or further subcontractor (so-called manual workers). This requirement does not apply to persons: managing the construction site, performing transport services, suppliers of building materials, equipment, devices, natural persons conducting business activity, members of the Contractor's management or supervisory bodies, partners in a general or partnership company to the extent that they will personally perform works for the Ordering Party or the Contractor.

The requirements concerning how to document the employment of persons for the employment contract, the control powers of the Contracting Authority and the non-hiring of persons for the employment contract are set out in detail in the proposed contractual provisions which are Annex 3 to the SWZ.

8. In addition, the Contractor's obligations related to the performance of the contract are also specified in the draft provisions of the contract (PPU) attached to the SWZ.

9. The description of the subject of the contract does not require taking into account accessibility for people with disabilities, no regulations are introduced in the scope of Article 100(1) of the PPL Act.
