1. The subject of the present proceedings is the purchase of electricity for the years 2024-2025 for the purposes of lighting public space and public utility facilities of the members of the Łódź Purchasing Group.The subject of the contract is divided into 2 parts of the contract:

- Part 1 – purchase of electricity for the years 2024 – 2025 for the purposes of lighting public spaces

- Part 2 - purchase of electricity for the years 2024-2025 for public utility facilities

pursuant to Article 38 of the Act of 29 January 2004 Public Procurement Law (Journal of Laws of 2023, item 1605, as amended), hereinafter referred to as the Public Procurement Law, an entity authorised to conduct the procedure on behalf of the units of the City of Łódź and entities (Contracting Authorities)

(the list of entities can be found in Appendix No. 1a to the OPZ for part 1 and No. 1b to the OPZ for part 2 of the contract)

The subject of the contract is the supply of electricity for the purposes of lighting the public space of the City of Łódź and other entities for the purposes of a joint procurement conducted pursuant to Article 38(1) of the Public Procurement Law. The supply of electricity includes the purchase and sale of electricity for the energy consumption points indicated in Appendix 1a to the OPZ - list PPE_cz. I_OŚWIETLENIE. The contractor must hold a licence for trading in electricity issued by the President of the Energy Regulatory Office, valid during the period of supply. In the present proceedings, the energy consumption points where the photovoltaic installation is installed are included. The Contracting Authority informs that it is in the process of constructing new generation installations and at the same time is considering the construction of such installations in other locations. The Contractor undertakes to repurchase the electricity generated in the Contracting Authority's installations at the price determined on the basis of the arithmetic average of all Fixing I prices quoted on the Day-Ahead Market operated by the Polish Power Exchange in a given Settlement Period, [PLN/MWh] published on the https://tge.pl/energia-elektryczna-rdn website according to the agreement template attached to the Terms of Reference.

The Ordering Party allows a change in the expected amount of electricity to be supplied in the range of -10/+10 % in the following circumstances:

- reduction of energy consumption points;

- increasing energy consumption points;

- changes in electricity demand

Duration of the contract: from the date of effective completion of the vendor change procedure for individual PPEs, but not earlier than from 1 January 2024 to 31 December 2025.

The supply of electricity includes the purchase and sale of electricity for the energy consumption points indicated in Appendix No. 1b to the OPZ - list PPE_cz. II_OBIEKTY. The contractor must hold a licence for trading in electricity issued by the President of the Energy Regulatory Office, valid during the period of supply.
