Minor operating and construction tasks within the water and sewer supply for Provas, Haderslev Forsyningsservice A / S (pre-qualification)

Provas - Haderslev Forsyningsservice A / S offers an asset and a resting framework agreement as a limited offering after prior pre-qualification.

The framework agreements are offered in accordance with the Procurement Act, Act No. 1564 of 15 December 2015, with subsequent amendments.

The framework agreements contain the following works:

- A1 - Larger plants,

- A2 - Repairs and minor works,

- A3 - Acute injuries.

The works under A1 and A2 are not binding on the builder (not exclusive framework agreement) and must be seen as a standing offer from the contractor which the builder can use as needed.

The workers under A3, on the other hand, are obligatory and are exclusive.

The framework agreements are concluded for a period of 4 years and there is no possibility of renewal thereafter.

Cascade Model:

The overall agreement is offered with a cascade model and therefore an active framework agreement will be signed with the winning bidder as well as a resting framework agreement with the bidder who has made the next best offer.

The contractor with the active framework agreement must supply all works under A1, A2 and A3.

With a cascade model, this means that if there are obstacles that prevent the winning contractor from delivering individual works under A1 or A2, cf. 1.1.1, the contracting entity can use the contractor who has been awarded a dormant contract, according to detailed conditions. .

The cascade model also means that if the contract between the winning contractor and the builder is completely terminated during the term of the framework agreement, possibly. due to default, the contractor with a dormant contract will be able to continue the framework agreement for the remaining contract period, without the contract having to tender.

The contractor with a resting framework agreement must therefore be available in the event that the contractor with an active framework agreement cannot deliver work under A1 and A2 and instead deliver the work himself. If the active agreement is terminated, the contractor with the resting framework agreement must take over works under A1, A2 and A3 with reasonable notice and thereafter become the contractor who has the active framework agreement.

When are there "barriers" that make work go to the contractor with a dormant contract. There may be "obstacles":

- If the contractor with the active framework agreement is unable to perform the task within the time stipulated by the client,

- If the contractor with the active framework agreement refuses to carry out works under A1 and A2.

- In the event that situations arise that the contractor with the active framework agreement generally does not have the opportunity to perform the task, including does not have the machinery available for the task, even refuses to perform the task, etc. If more than 3 assignments are made within a continuous period of 3 months, assigned to the contractor by a dormant contract, the developer can terminate the active framework agreement on grounds of default and hand over the entire agreement to the dormant tenderer.

The winning bidder cannot refuse to perform A3 work and should the contractor with the active framework agreement not be able to comply with the framework agreement, including in particular complying with the conditions for work performed under A3 and the deadlines therein, the assignment may go to the contractor with a resting framework agreement or 3rd man of his own choice. In this situation, the contractor who has the active agreement is obliged to pay as well as any. additional costs for the developer as a fine, cf. the provisions of the Framework Agreement in section 5.
