Environmental impact study, technical contribution to the Water Framework Directive on the consideration of the relevant management objectives according to §§ 27 to 31 WHG, FFH impact studies, species protection contribution (saP), landscape conservation accompanying plan

The environmental impact study with further investigations is intended to assess the effects of the measures to expand the flood protection system in the Isarmünd polder area on nature and the environment.

For this purpose, the overall environmental planning contribution of the planning approval documents must be prepared. In particular, the following services are to be carried out: inventory analysis/evaluation, inventory/conflict impairment analysis, avoidance/minimization, impact prognosis, intervention balancing, exception procedure, preparation of a landscape conservation accompanying plan that integrates all measures from all environmental planning contributions.

Affected areas, description of the service and circumstances to be taken into account are presented in the award bases.

The subject of the award to be put out to tender consists of environmental planning reports and technical contributions:

a) Umweltverträglichkeitsuntersuchung

An approvable environmental impact assessment must be carried out for the entire study area with a size of approx. 140 ha. When preparing the environmental impact assessment in accordance with the EIA Act, the specifications of the following "guidelines" must be taken into account and, if necessary, modified to the current state of science and case law in coordination with the client for project-specific concerns:

b) FFH-Verträglichkeitsuntersuchungen

During the preparation of the impact study, the specifications of the following "guidelines" as well as the current state of science and case law must be modified in consultation with the client for the project-specific concerns, if necessary:

Federal Highway Construction (FFH-VP Guideline) - 2004 edition - and sample maps for the uniform presentation of FFH impact assessments in federal highway construction (FFH-VP sample maps) - 2004 edition.

FFH management plans for the FFH and VS areas Danube and Danube floodplains between Straubing and Vilshofen and the mouth of the Isar are expected to be submitted to the government of Lower Bavaria at the beginning of 2023 and must be observed.

c) Special species protection investigation

When preparing the species protection study, the specifications of the following "guidelines" must be taken into account and, if necessary, modified to the current state of science and case law in coordination with the client for project-specific concerns:

According to the guideline of the Supreme Building Authority in the Bavarian State Ministry of the Interior, the species protection expert contribution for the special species protection assessment (saP) according to §§ 44 and 45 BNatSchG is "Notes on the preparation of nature conservation information on the special species protection assessment" (version as of 08/2018).

d) Landscape conservation plan within the meaning of the intervention regulation according to §§ 18 to 20 BNatSchG

During the development of the accompanying landscape conservation plan, the specifications of the following "guidelines" as well as the current state of science and case law must be modified in consultation with the client for the project-specific concerns, if necessary:

Cost calculation for the accompanying landscape conservation measures

Participation in the preparation of land acquisition plan, land acquisition register, list of buildings compensation measures

When implementing the intervention regulation, the valid legal regulations on the compensation of interventions in nature and landscape under nature conservation law are to be applied.

e) Technical paper on the Water Framework Directive

(Compatibility with water protection concerns according to WHG and BayWG)

f) The environmental planning content must be prepared for inclusion in the explanatory report of the planning approval documents.

g) A very intensive technical and content-related coordination, e.g. contents, texts, planning contributions, impact forecasts, intervention-compensation balance, multifunctional planning of measures, integrated LBP, cartography, plans must be carried out in order to ensure the merging of the individual expert opinions and technical contributions into a common approvable document.
