The subject of the contract is the delivery of electrosurgical diathermy of the Otolaryngology Block in accordance with the price form constituting Appendix No. 2 to the Terms of Reference, the List of Required Functions and Technical Parameters constituting Appendix No. 3 to the Terms of Reference and in accordance with the Appendix
No. 4 to SWZ.
2. The Contracting Authority informs that in the said procedure conducted under the
open tender procedure provides for the possibility of applying the procedure referred to in
referred to in Article 139(1) of the Public Procurement Law. The contracting authority, when applying the above-mentioned
procedure will first carry out an examination of the
evaluation of bids, and then shall qualify the Contractor whose bid is
was rated the highest in terms of the absence of grounds for exclusion and the fulfilment of the
Terms of participation in the proceedings.

No. 4 to the SWZ
2. As part of the implementation of the subject of the contract, the Contractor is obliged in particular to:
1) delivery of the device to the Ordering Party's headquarters - Regional Specialist Hospital named after Dr. Wł. Rydygiera 15/17, 86-300 Grudziądz and its unloading and carrying to the place of
and to a room indicated by an authorized representative of the Contracting Authority,
2) installation of the device, including the assembly of all elements of the device's equipment that require assembly / assembly and connecting the device to the installations necessary for its operation,
3) starting the device and performing all other necessary activities required by its properties, so that it is possible to start providing health services using the device,
4) deliver and issue to the Ordering Party together with the device the originals of the necessary documents regarding the device (in the case of documentation prepared in a foreign language with a translation into Polish), including in particular the instruction manual prepared in Polish, complete service documentation, warranty documents issued by the device manufacturer and a technical passport,
5) conduct, within 7 days from the date of delivery of the device, training for medical personnel indicated by the Ordering Party in the field of its proper operation confirmed by an appropriate protocol,
6) providing a warranty and warranty for defects in the device along with providing warranty service on the terms and conditions specified in the contract,
7) perform technical inspections during the warranty period in accordance with the manufacturer's recommendation (after completing the required technical inspections, the Contractor is obliged to prepare and submit service reports to the Ordering Party)
