The subject of this contract is the purchase of electricity for the Employer's facilities and organizational units indicated in Annex No. 1 to the ToR. The Commune of Wohyń and the Members of the Purchasing Group together with the units listed in Annex No. 1 to the ToR will conclude separate contracts resulting from this public procurement procedure in an open tender. Detailed information on the conclusion of contracts by individual Purchasing Group Members and their organizational units is contained in Annexes 1 and 4.1 to the ToR. The obligation of the selected Contractor will be to terminate the existing electricity sale and distribution services agreements (comprehensive agreements) and to represent the Ordering Party and its organizational units before the relevant Distribution System Operator in matters related to the conclusion of new distribution agreements. To perform the above actions, the Contractor will receive an appropriate power of attorney (attachment No. 4.1 to the Terms of Reference).

1) The Wohyń Commune and the Members of the Purchasing Group together with the entities listed in Annex 1 to the ToR will conclude separate contracts resulting from this public procurement procedure in an open tender for "Purchase of electricity for the needs of the Wohyń Commune Purchasing Group". Detailed information on the conclusion of contracts by individual Purchasing Group Members and their organizational units is contained in Annexes 1 and 4.1 to the ToR. The obligation of the selected Contractor will be to terminate the existing electricity sale and distribution services agreements (comprehensive agreements) and to represent the Ordering Party and its organizational units before the relevant Distribution System Operator in matters related to the conclusion of new distribution agreements. To perform the above actions, the Contractor will receive an appropriate power of attorney (attachment No. 4.1 to the Terms of Reference).

2. Order - purchase of electricity for the facilities listed in Annex 1 to the ToR:

1) Estimated electricity demand in the period from 1/1/2020 to 31/12/2020 is 10 124 930.00 kWh.

2) The estimated value of the contract in the period from 1.1.2020 to 31.12.2020 is PLN 3 644 974.80.

3) Performing activities resulting from the power of attorney, constituting Annex No. 1 to the draft contract (Annex No. 4.1 to the ToR), in particular the Employer obliges the Contractor to notify the indicated Distribution System Operator for the implementation of the electricity sale contract concluded with the Contractor, making declarations of will and determining, on behalf of the Employer, all necessary information regarding the termination of the current contract for the sale of electricity and provision of distribution services (comprehensive agreement), representing the Employer before the relevant Distribution System Operator in matters related to the conclusion of the contract for the provision of distribution services.

3. The Ordering Party, acts on its own behalf and on the basis of a signed Agreement (Agreement available for inspection at the Employer's headquarters), on behalf of the following Purchasing Group Members as well as their organizational units, which are indicated in Annex 1 to the ToR:

4. The Ordering Party informs that the process of changing the seller takes place for most of the collection points once again. Detailed information on the dates of valid electricity sales contracts in the event of another change of seller and the periods of notice of comprehensive contracts in the event of the first change of seller are included in Annex 1 to the ToR. Annex 1 to the ToR indicates the current electricity seller and information on currently concluded price agreements. Contracts for the distribution of electricity in the case of points with another change of seller are concluded for an indefinite period.
